How long must a plaintiff be a resident of a new home in a new state before Diversity Jurisdiction no longer applies? Is 1 year enough and if so, would that be before or after they file taxes?
Thank You. ONE

I live near St. Louis and I'm looking for someone who can help me find out exactly who this person that has been "magically appearing" in my life, whenever he wants, for a few years now. I'm familiar with all the sights on the net that you can pay to get info, but i'm very skeptical. Basically I just want a criminal background check on the guy.

If the ACLU is really out to defend constitutional rights, tell me why it does nothing at all about all the innocent people that have had their lives ruined and children taken away from them, often for years, by any of the child protection agency [ies] of the individual states? "rights" to accuse anybody of the neglect, molestation, or abuse of a child are accorded to the accuser, not the person accused.

this was all set up by the Mondale Act, a/k/a CAPTA, when Walter Mondale was vice president (btw, Janet Reno, who engineered mass killing in Waco, TX, got into office because she was the florida champion against anyone accused of such acts against children).

the constitution guarantees that an accused must:

1. have a speedy trial;

2. know who his accuser is;

3. have court-appointed counsel if he cannot retain his own attorney;

4. and other rights.

... TBC, look below:

If potential employers perform a back ground check on you is there anyway to find out if they have? I know that they need a written autorization to before one can be done, but that doesn't always happen.

ok heres my situation... my sons dad was not there at his birth and has never really been there through out his life (pops up every now and then).. I am the one thats raised him, provides for him and does any and everything he needs... so i feel i should be the one to have full rights over my child ! i have no problem with his dad seeing or spending time with him but point period his fathers not interested.... so my question is what is the easiest way for me to obtain full leagal custody with out obtaining a lawyer...
also take into consideration that the father would more then likely be willing to sign his rights over to me.
and his father is a felon, has a history of drugs and violence (violence on me, not our child).
lastly I live in Florida.

this question is not good or bad habits.. but about gov. being able to tell you what you can and can not do..
In charlotte, NC the gov passed a law saying you can not smoke in public or PRIVATE clubs or restraunts. they are also looking to pass a "FAT TAX" meaning if you eat things they think are bad you pay extra taxes... do you think gov. should be able to tell you what they think....

Remember the power you give the gov. today will be used against you tomorrow when the other side is in charge.

If you think it's OK or good, just flip this situation around. How would you feel if a Democrat president agreed to send his staff to the Hill to answer questions of a Republican-led Congress - but not allow them to be required to swear to tell the truth. Does this really feel OK to you? Honestly?
