Law & Ethics - July 2006

I'm being prosicuted for mulputiple accounts of first degree sexual conduct with one minor. They offered a plea to year max plus other conditions, verus 12 years. Does this mean they don't have a case and really just want to end the case. My lauyer is really pushing me to go to forward with his cost of 26 thousand. I did not do these things but have a issue with one year versus 12 years.

Any advise would be greatful

I am licensed to practice law in New Jersey and was wondering if it would be possible to move to another state without "waiving in" and doing things like bankruptcy or immigration- anything in the federal courts that only require you to have an active license in a state. Someone told me that if you're actively licensed in one state that there are certain kinds of things you can anywhere. Yes, I know that some states have reciprocity, etc, but I really don't feel like moving to D.C., etc. I would like to move to Ohio for a year or two and not have to take the bar exam there. Are there any areas of practice that I could do while there with my NJ license?

Any good suggestions would be appreciated. If you don't know the answer to this question, please don't answer it, thanks!

2 soccer players get into a fight they're from opposite teams. Both minors. One of them is charged with assault with a deadly weapon for using thier cleats. Details: player1(P1) is aggressive makes hard tackles & uses verbal intimidation. Player2(P2) is placed on the field as a sub, within 5 minutes P1strikes P2 in the back with the elbow & fist. P2 turns around & warns P1 not to do that again saying that P1 will "learn a lesson". P1becomes angry & comes towards P2 cursing & shoving P2. P2 puts their fists up & strikes P1 in the eye knocking P1to the ground & P2 strikes P1 several more times in the eye. Coaches & parents come on to the field & separate the players. P1 appears to be injured & the police are called. ambulance comes takes P1 to ER for an eval. statements are taken. Officers decide P2 is guilty of using cleats to strike P1. P2 is arrested & charged. P2 has no police record, never been in a fight or struck anyone ever. Parents of P1 say cleats were used P2 parents say no.

Speaking hypethedically, lets say there are two serial killers or rapists, both are convicted, but one is sentenced to death, in a high-security prision, where they couldn't be harmed, and the other is sentenced to a medium-security prision where other inmates are "free" to beat, rape, and torment an inmate. Which of the two is justice, an eye for an eye, or a dose of their own medicine? Are there worse things than death?

About 2 weeks ago here in my state, we had a 5 year old chlid go missing. A week later they found her in a neighbors basement, dead and assaulted. I think that sex offenders should be chemically sterilized, put to death, or put away FOREVER!! What is everyones oppion?

My HOA owns a parcel on the river considered common property. It's recorded on the plat map saying "permopen space for the public". The "Public" has been extremely disrespectful of our property. There is a LOT of alcohol, drugs, sex, fighting, partying, litter , on the property and in the river, and are also re-directing the river by creating dikes. The HOA pays the property taxes and insurance premiums for that parcel! We have been calling the county office to gate it off to the public because of their illegal activity, and recruited the Fish & Wildlife dept as well as the Sheriff's office to support this effort. Some of the county officials say that if the public can't respect the property, then we have the right to **** it down due to the liability factor and the safety of our members. We put up our No Trespassing signs last night and I called one more county county official who said we need to have a hearing to change this. Please help. We need this shut. Can they do this?

My son married this girl after Knowing her 6 months she is 4 yr older than he is.She is very rude to me and jealous of me. Don't know why.I have 7 kids and my son is the 2nd oldest.Well this girl started a lot of conflect between me and my son ,but all so my daughter who ranway and she moved in with my daughter in law and son. I had no problem with that. But than they moved didn't give me a new number or address. after a few months I found them and contacted them and my daughter in law called me every name in the book.and told me i was never a good mother to them & i should have the other kids taken too. Well she tryed several times call child pertective servises and twice the police trying to get me for using drugs. well it didn't work they tested me and nothing, now 3years and I found my daughter not my son or his wife,and here my daughter in law calling agin.how can i stop this . I am not testing agin or having c.p.s. looking in my house or life.what can i do?

I need to build my own instrument sounds for my MIDI'S to run through... i'm curious about the legalities of sampling other samples i legally own? since the samples are only used to play the music, i'm not selling the samples on themselves - is it legal to do or do I have to actually make all the sounds from scratch?

i'm paying $721/mo. rent, and in this area that is a fairly moderate rate for rent...not chic but not the ghetto either. when we moved in in april, they said we had A/C and a pool (among other things). we soon realized when summer approached that our A/C was not working properly. after 6 maintenance calls they determined that nothing was wrong with the unit, but infact it was "due to the fact that you are in an upstairs apartment and there is no insalation between the ceiling and the roof". my apartment exceeds 90 degrees everyday! and i have an infant child, i've asked the landlord if we can move to a downstairs unit, but they said "no" and gave us a box fan to use (all it does is blow the hot air in your face). also the pool is closed for the season so we can't even get any releif that way. is there something i can do? contact BBB? take them t o court? something

I work in a refinery plant in wich constant drug testing and alchohol breathalizers are done and i totally agree with it to an extent. I feel that if you havn't smoked pot or done drugs within the past 24 hours you should be considered okay to work, they do this with alchohol and it impairs you worse than pot. I feel it is wrong to drug test as far back as urine will let them see. I say a law should be put in act against drug testing unless you have done it within 24 hours or am i just missing weed too much. I miss my weed.

My son's father applied for Disability through social security in 2002, he was recently approved after a long bout with SSA and he may be approved. During this time I had to care for my child on my own and I know that his dad will receive back pay, but will my son also??
