i'm paying $721/mo. rent, and in this area that is a fairly moderate rate for rent...not chic but not the ghetto either. when we moved in in april, they said we had A/C and a pool (among other things). we soon realized when summer approached that our A/C was not working properly. after 6 maintenance calls they determined that nothing was wrong with the unit, but infact it was "due to the fact that you are in an upstairs apartment and there is no insalation between the ceiling and the roof". my apartment exceeds 90 degrees everyday! and i have an infant child, i've asked the landlord if we can move to a downstairs unit, but they said "no" and gave us a box fan to use (all it does is blow the hot air in your face). also the pool is closed for the season so we can't even get any releif that way. is there something i can do? contact BBB? take them t o court? something

I am a landlord....and have also been a tenant, and sold RE for several years, and do property management now.

A. review lease agreement/month to month contract; see if there are specific issues addressed regarding providing these items AS PART OF your rental agreement.....here is the ENFORCABLE aspect in court.

B. Consider a call to the local health department and/or code enforcement division of your local government agencies....trust me, no landlord will want his property red-flagged as uninhabitable....they will lose their *** until things get fixed if they get written up in violation(because it is illegal to collect rent if in violation)

C. Ask the owner of the building ...NOT JUST LANDLORD to come by the place in the HEAT of the day....to see how they like it inside with the heat at that level..

D. Go buy an additional AC unit with sufficient cooling capacity...and replace the inadequate one....when you move, put the inferior one back.

E. Scour your local advertisements for new housing...trust me...landlords can be skinflints....remember, it is "income property" and the least amount of "expense", the better...hence LARGER profit margin....but do your homework FIRST....check BBB, and local gov't agencies for similar complaints....remember, you ain't the first...and you ain't gonna be the last.

Check the building codes for apartments in your area. Find out about laws concerning roof insulation. You may have a good lawsuit if you or your child are harmed by the heat and the apartment doesn't meet code. Most any contractor from the yellow pages can probably help you find out what the codes are.

Do you have a written lease saying there was an AC and a pool? You can file a complaint with someone if you have some written info. Otherwise it may be your word against theirs. You might have to get a laywer, and I don't know how serious you are about getting the problem rectified.

This sounds like you may have been constructively evicted. Consult a lawyer in your area. You may be able to leave the apartment without repercussions because it sounds rather unliveable.

Call the local news and have them do a report on it. I bet your apt complex would straighten up then. Once you broadcast them everywhere.
