First, you know very well whether you committed the crime you are accused of. If your conscience is clear, you should not agree for any compromise, whatever be the likely outcome of the prosecution. If you are on the wrong foot, you bargain, as per you capacity to pay and endurance.

The plea is there to get a sure conviction. They are just trying to save the costs of a trial and subsequent appeals. It aslo looks good to have a lot of convictions of this nature come election time. Frankly, it sounds generous. I would have thought at least three years, so; the case may be week, but; that is not a gamble worth taking if you are not innocent and can prove it. They will come after you with everything they have to make their case. If you pleed not guilty and get off then you are free and it only cost you 26,000. If you are found guilty it is 12 years, minimum of three with good behavior. That is why I would have thought three. Anything less than three is a gift. However, If you pleed you are a registered sex offender for the rest of your life and that will effect you no matter where you go, so; think long and hard about this one. They don't look kindly on sex offenders in or out of prison.

The plea would let the prosecution make a deal with the judge. Thus the judge could give you a minimum of one year to the maximum of 12 years. With a plea you will likely be on the low end.
If the lawyer makes sure it is only one year, pay him with a smile. It is a good deal.

If I were innocent, I wouldn't plea. In your case, you'd have to plead guilty and be classified as a sex offender...not a good thing. That's even if you survived prison....most people don't look too kindly on sex offenders. Most lawyers try to plea bargin when someone intends to plead not guilty...it saves them from having to go to trial, which is very time consuming. Your lawyer should know what evidence they have against you. HIs trying to get you to take the plea might mean that the prosecution has strong evidence against you. Talk to your lawyer.

If you plead guilty and take the deal they are offering, you are considered guilty. You will have to register as a sex offender and be forever marked as such. You should go forward with the case. Let a judge or jury decide. Your lawyer has to act in your best interest, he doesn't have a choice. He isn't going to tell you to take it to trial if he thinks there's no chance of winning. If you are truly guilty, then plead guilty.

It means they have enough to go forward with a court trial, but they are hoping to avoid a trial which costs the state a lot of money.
