i just want to know, like im walking down the street, and for no reason some guys with short shorts and pink wife beaters with the words "DONT HATE ME BEACUSE IM GAY" start hitting me and slapping me. is that a hate crime?

For any crime to qualify as a hate crime, no matter if it is based on race, religion, sexual orientation, or whatever, there has to be proof that the person committing the crime chose that victim for no other reason than the victim's race, religion, sexual orientation, etc.

Generally, the way that proof comes about is based on statements the offender makes either to the victim prior to or during the attack or while speaking to the police. Sometimes, the police or district attorney can take a collection of the offender's past actions to show a pattern of hatred towards the particular group that the victim is a member of and prove it that way. These past actions can be other crimes, memberships in hate groups, things the offender has written, statements made to others about that person or group, or similar things.

If the police or district attorney can show a pattern of hatred from the offender or that the offender made some hateful and discriminatory statement towards the victim, then the offender can be charged with a hate crime. If there is no pattern of behavior and no discriminatory statements were made, it will not be charged as a hate crime.

It is possible for a member of one group to commit a crime against a member of another group, even one that has been historically discriminated against in general, without it being motivated by the differences. It is also possible for a person to commit a hate crime against someone that is a member of the same group as the offender, if it is based in a discriminatory hatred.

So, based on the scenario you described, no, it would not be a hate crime. If these same people did this to you and said something along the lines of "We hate breeders!", then yes, it would be a hate crime.

It's funny like a joke.

That has to be one of the strangest hate crimes I've heard of. A gang of gays attacking a straight guy. What an ironic reversal twist thing.

You should go inform the neighborhood police department.

This time I really don't have the answer of this question, I really want to give u an answer but I just want to say that being a gay is not a bad thing as per Ur mind is agree but in reality it ain't good.I know this answer may not going to solve that going on in Ur mind.

I'm not 100% sure but I would have thought that if any person/group of people started beating up/causing harm in some way to another person/group of people for no apparent reason then the person/group of people who were attacked should be able to take it to the local law enforcement (police).

Id say if you stand there and take it you probably deserve to get forcably boarded by the butt pirates. If you go to the police and claim a bunch of pink clad effemete men beat you down theyll probably laugh you out of the station.

Well, if they start shouting, "Die, Straighty!" maybe it is. But I sort of have a feeling that sort of thing is not likely to happen.

I think you might not like gay folks too much. Too bad, too. They can be fun to dance with. AND they don't harass little guys like big-*** macho bricks do.

I don't see why it wouldn't be,If a bunch of straight guys beat the crap out of a gay guy that would be a hate crime.they would say we only kicked that a ss because he is gay.
