It's a question of terminology. An executor is named in the will of the testator. Where there is no will, then letters of administration are taken out and the personal representative will administer the estate with the same powers and authority as an executor. But he can't describe himself as executor.

In California the term "Personal Representative" is the same as Executor. It also includes "Administrator." An executor is the personal rep when named in a will. An Administrator is a personal rep when there is no will. They are all essentially synonyms.
