If a woman at home shoots and kills someone who she sees breaking into her home, is this voluntary manslaughter? If not, what kind of homocide is it?

I'm due in court in 8 hours time to testify about my ex hitting me on a 2nd common assault offence.

The CPS have asked me to attend as witness, which I agreed (but personally didn't want to - stress!) - because otherwise they would summon me.

They are the ones prosecuting, not me. I dont think I can attend, what will happen if I dont show. I should be in bed now, but can't sleep, worrying about this.

Don't get me wrong, my ex is a complete idiot and has lost me for life for what he did, but I cant face the court thing - feel ill.

I know a guy that went to prison for 7 years for having sex with one of his classmates. This did not happen in the 1960's and 1970's. While maybe it was wrong the punishment is too severe as this kid was still in high school.

And they have to register as sex offenders for the rest of their life, and maybe even be desginated as a sexual predator even though they were normal 18 year old kids.

Look I'm not saying it is ok for a 23 year old to be with anyone still in high school and they would deserve the 7 year prison sentence, but a kid still in high school having sex with another kid in high school.

I remember when I was 18, I only a adult legally not mentally.

What is legally required to obtain an order to vacate? My husband had a very emotional and violent outburst tonite (one of many) and my children and myself are terrified. I didn`t report any of this because he will be back in our home the next day, only to abuse us further. How can I get him removed permanently so we can sleep without worry? Only honest answers please. Thanx in advance.

It's not just Iraq... All Americans need to revisit the history of our American and also of the French Revolution. America please wake up! Please revisit and understand the beliefs of Thomas Jefferson. How much more perversion of power must we endure? America may never recover from these self proclaimed Kings, Dick Cheney and George Bush, endless we take action. This is very serious... this is treason against the people and the American Constitution. Let the world know that America has not forgotten it's principles. This administration is guilty of Treason against the American people. We must make a bold statement to undo the evil that has engulfed us. They claim to be God fearing... they are not. They are Evil... The whole world is watching.

I went shopping at walmart and when i was leaving a lady came running at me from behind the register really really snotty and said.. I NEED To SEE YOUR RECIPT..
I said its in my purse sorry.
I need to see your recipt..
I said I do not pay for a membership here. You can not legally look into my purse or my bags. What is your cause for stopping me. Odviously the way she approched me really off set me and I left her area and walked out the door.

In Califronia can they legally stop you to ask you to produce your receipt. Walmart told me that they have every right to ask you to produce your recipt so they can look into your bags. I am sooo angry. I will not be shopping here again unless I know my rights. Please help.

a man is caught on tape, (the alleged abuser, has a friend in the police, hence the reason for taping him in the first place.) bragging about abusing his granddaughter, taped by his friend. the friend then goes through all the proper channels, reports it to the police, tells them he has the tape. they get serious crime squad involved, then it dries up, nothing happens. they didnt even collect the tape, and no contact since,
this cannot be right can it, his (the aleged abuser) friendship is more valuable to the police friend, than a 4yr old girls well being.
what do you think,
this is true 100%

I am familiar with The Fair Debt Collection Practices Act for consumers. Is there a law in California that protects businesses from the same harassment from collection agencies (phone calls at unusual hours, calling business vendors notifying them of debt)?

Thank you in advance for your assistance.

I own a home in Texas. When I returned from a vacation, I saw that my next door neighbor put up a new fence. In order to do so, she had to put up new posts and lay new concrete for those posts. Whoever installed the fence did not clean up on my side of the property. There is dried, hardened concrete blocking my walkway between the fence and my house. The concrete is not level with the soil, so it will be nearly impossible for me to plant new grass to hide these little slabs. They left piles of dirt where they were digging. Also, the workers left a ton of trash on my property.

I know she is responsible for the damages to my property because of the faulty workmanship, not to mention the fact that her workers were trespassing. But in the past she has not been a very accomodating neighbor.

Any advice on how to deal with this situation and not cause a ruckus in my neighborhood? I simply want my property back in the condition it was before I went out of town.

In process of battling a felony theft charge. DA is prosecuting, but the person that accused and the star witness has been harasing me for over a year. I have reported most of everything that has resulting from the harassing, but want to file a protective order and file harassment charges too.. considering trying to sue for criminal intent as well as in civil court. my question is should I wait until the criminal hearing is over. would it be construded as trying to retaliate for the charging me with a crime(I can prove everything is false, but have to go thru the process to do so). or would the courts allow for an impartial and fair process if I were to proceed with the harassment charges now?

Ok, so this guy I know just died, & he had a baby with my sister. He was a military veteran. Is she entitled to any Social Security benefits like SSI or Social Security? & also, my friend just slept with this guy & we just found out yesterday AFTER he died-that she's pregnant & the baby could possibly be his. Is it true that we can get a DNA test before he gets buried & save it for when the new baby is born? & if it is positively his, can that baby get benefits too?

Sorry but he was a promiscuous 40-yr. old man.
