What is legally required to obtain an order to vacate? My husband had a very emotional and violent outburst tonite (one of many) and my children and myself are terrified. I didn`t report any of this because he will be back in our home the next day, only to abuse us further. How can I get him removed permanently so we can sleep without worry? Only honest answers please. Thanx in advance.

What you want is a restraining order -- an order to vacate has a different meaning in legal parlance.

You would need to go down to your local courthouse, and file for a restraining order. They can help you with the forms, and they usually have a packet that explains the procedure and what type of evidence you would need to present at the hearing.

First of all you have to go to the police and tell them what had happen, base on what you tell them they going to issue an order of protection, with this in your hands you can start any process against him, even you can call 311 and they give you the Domestic Violence Hot line, and they can make him live for good. do what you have to do before things get worst. be strong and good luck to you and kids.

If you and your children are in danger, you need to get away from him as soon as possible. Is there a shelter for women in your situation where you live? Maybe they can help you with your questions.
