if the cops want to give you a breathalyzer can you ask for a lawyer to be present before giving one?

my daughter was told by her employer that she cant take 12 days off her work for her summer holiday as this will be on her emplyers busiest days !! even though my daughter booked this 24 weeks before and told her employer. the boss has now looked at it and decided that it wont suit her as she will be losing money! what are my daughters rights ? the boss reckons hairdressers holidays work out different from everyone else!!

My boyfriend purchased a surround sound system in Virginia in 1997- which was later returned to the company. Now they are sending him notices stating that the origional amount (2,500) is now $7,500 worth of debt. I thought that each state had a cap on how long a party could collect against a debt- 10 YEARS later they are trying to collect on something that was returned to them stating they never recieved the items back- is this even legal??

We bought a home in January 2007. We have had many electrical problems, and now some flooding in the front of the house with no explanation as of yet. The house was a flip, and we wonder if there was a lot not disclosed and wonder if there is anyway to get out of this house.

my husband got into a little trouble when he was 18. he has to pay restitution . Well we have been really tight with our bills and havent been able to make his monthly payments for a couple months. does anyone know what will happen??? we live in maryland. if i ask him he will just make it sound like nothing if it is something just so i wont worry. please help! we just got a call today from this lady from parole and probation saying that his case was just transferred to her. do they do this if something is going on with the restitution payments or does this just happen sometimes??

should the government decide whether or not law-abiding individuals should be allowed to own guns?
does the argument that taking away gun ownership will bring better security to the public have a validity??
apparently in britain those who represent the country in gun shooting events have to practice outside of the country?

i'm just trying to get objective arguments for both sides.i'm personally neutral on this issue.

Here is a tricky question maybe someone can help me on this.

My father and i have the same name ,except different middle initals.

Somepoint in my fathers life he started using my middle initals on his signature.(i dont know why)

Now on a quitclaim deed he signed my name, instead of his on the quitclaim.Over to my brother which is a sneaky guy.

Is this quitclaim valid?

Could anyone PLEASE help me with this as I have to make a decision by Friday. I am on the ARD program in Allegheny County Pennsylvania. I am also on disability and with the restitution payment I am supposed to live on $389.00 per month. These so-called "court fees" are $1,200, which was NEVER explained that it would be sooo much money. Which is part of the problem. AFTER you sign the contract, they lower the boom and reveal the amount you thought could only amount to around $200.00. This is decptive, yet they are getting away with it. the whole spirit behind the ARD program is that intigent people can pay their debt and still go on with their lives. I have until Friday to appeal this denied court order to remove these court fees. I have found that upon leaving the local politics, and going up higher, ie, Commonwealth Court or Superior Court, justice is more previlent. So folks, should I appeal this order or what. PLEASE GIVE ME SOME ADVICE HERE AND THE CLOCK IS TICKING.

My father passed away on August 13th. He had a massive heart attack and had very little brain activity,severe brain damage, and no possiblity to recover. He was married to my mother for 17 yrs but for the last 8 he worked out of state. He had a girlfriend whom he shared a joint checking account. I know that's probably a lost cause but he owns vehicles and personal items that she refuses to return. What are my Mother's legal rights? We can not afford an attorney and have been without and income since the week before he passed.

65 days ago my sargent and comander took away my driving privliages until futher notice due to me getting arrested off post for a burn out. a feild grade artical 15 last 45 days, plus 45 days of restriction. i have not been convicted or recieved a ticket of any sort and no documentation stating that my privilages have been rovoked other than my high risk counsling sheets. are then any army regs that state the length of punishment and or the comanders ability to restict my privliages of post, when the inccident was off post and was completly un realated to the military. any information would be appreciated.

Ok so my boyfriend quit his last job for one making almost double what he was. He told them monday that he was going to finish out his 3 day shift and wasn't coming back. He was suposed to get his paycheck on thursday last week. When he went to pick it up they said they had already mailed it. It is now tuesday and he stil hasn't received it. He called asking about it and they told him "that was a pretty calssy thing you did not giving a two week notice we'll see what we can find out" now they wont return calls or tell him anything. Mail around here going to the same zip code as it originated from normally arrives 1 to 2 days later. its been 4 now. I think they are trying not to give a check. are they allowed to hold a check like that? and how long qould you have to wait before filing a complaint with the labor board if they do? Please help! Our bills are due and no way of paying them ;(

A jerk family member snuck up on me while I was disciplining my stubborn dog, and was filming me. He claims that I was abusing my dog and he says that hes going to send the video to people and show everyone he can think of. I wasn't hurting the dog, this relative is a stereotypical tree-hugger type of guy. He makes it sound to others as if I was an axe murderer! Is sending this video to others legal??? I had know idea that he was standing there. His sole purpose to show this video is to slander my reputation, by making me out to be this evil person that I'm not. I live in Canada, and I know that laws very from place to place, so any people who know a lot about Canadian law greatly be appreciated.

I was babysitting for my brother when we decided to go to the park my neighbors who is the same age as me wanted to go I told her I dont care So they came with us my brother (preschool) put sand in my neighbors sweater pocket place She got all mad and started to yell and cuss I thought she was yelling at my brother so i told her to stop yelling and getting mad (nicely) (I could have told my brother to say sorry and stuff but she didnt give me the chance because she was yelling and cussing). So i thought the best way to handle this was to just go home. Then we sorta got in a fight. My sister in law came to me with a question that I really dont' know the answer to. She bought a truck from a buy here/pay here place and she made a hefty deposit of $1,750.00. the intitial cost of the truck is $3,000.00 plus $500.00 for carrying loan for total of $3,500.00. They claim that if she had any problems to call them and they can tack on any improvements they make to the loan. Well the transmission went out and had to replace the drive shaft, was just the first issue, then front wheel bearing assemblys on both sides, along with other smaller issues. She called but never receieved any calls back, she was unable to drive it because of tierod ends and bought a van to drive in place and didn't make any payemnts after words. After 3 months they just now called her, and already has a recovery looking for it. Even though its hidden well(NOT INTENTIONALLY mind you) She wanted to know her rights, she doesn't have much money to invest in lawyer so were looking for others help first.

About four months ago a moronic security guard tried to stop me from leaving a parking lot by running in front of my car. It completely surprised and shocked me. I wasn't expecting it. I hit my breaks to keep from hitting him. He called the cops and told them this moronic story. I had to post a $5,000 bond. I showed up at court and was told that the case had been cancelled and that I wouldn't be charged with anything. But, now no matter how hard I try or what office I talk to, I can't get my $5,000 back. I contacted a lawyer about this. He got back to me a few days later and told me for a $1,000 fee he could get the bond released right away! I just can't afford that. Is there any other way?

I am behind on one payment, the next thing you know my mother, one of my references for the loan, called and said to give thme a call. I was very upset b/c I was really trying to make arrangements. I let the manager know that I really did not appreciate it and end the conversation. He later called back and left a detailed message on my voicemail stating that he will continue to 'harrass' my references as long as he wants to. I found that unbelievable and I am certainly appauled. What are my rights? Is that type of treat legal?

Mental illnesses are covered by the Americans with Disabilities Act. But that is with employers and employees. I was wondering do people that suffer from mental illness have any legal rights regarding to education? I mean in the high school and college sense. Because students with these illnesses often have bad attendance records which leads to disciplinary actions and sometimes legal, truancy, trouble.

I asked this once before, and got a few good answers. But I just couldn't bring myself to call her, and wound up procrastinating until I accidently let the question expire. I'd like to give the people who gave me such good advice another chance at the points - this time I promise I'll pick a best answer whether I get up the guts to call or not. Here are some details for everyone else:
I bought a cellphone recently from a place that buys, sells, and repairs cellphones. and after I took it home, I realized that it still had some videos in it. I watched them, and one of the videos shows the owner of the phone being proposed to. Her Mom's phone number is still programmed into the phone. I feel torn - should I try to send her the video? It's possible the phone was stolen, and sold to the store I bought it from (that didn't occur to me until my husband brought it up). I feel weird calling someone's Mom out of the blue -- but I would want this video clip if it was mine....
