In criminal court, d) bail. In civil court, c) the right to testify.

Well, I know that when we had to take someone to court for some bad work they did on our house, that person didn't show up and in doing so, the forfeited their right to testify, which meant that we won the case by default.

Unless they go before a judge and its put on record that they forfeit ANY of there constitution rights. Then they hold firm and they still apply.
