Tom, a teenager, is mucking around with some friends at the Rocky Municipal Pool. The boys are running around, shouting and throwing tennis balls at each other. The pool's supervisor is busy chatting to some girls at the other end of the pool. Large signs displayed around the pool proclaim “NO RUNNING OR DIVING. Pool edges slippery when wet.” Suddenly, Tom slips on the tiles surrounding the pool, twists his ankle, and falls into the pool, hitting his head on the edge and suffering serious injuries. Tom sues the pool owner (the Council) in negligence. Evidence shows that the tiles used next to the pool are particularly slippery when wet, and that other types of tiles or waterproof carpet (at considerably more expense) would prevent the edge being slippery. Discuss the Council's liability, ignoring any defences it may have.

The council breached its duty of care in that it was negligent through failing to adequately supervise its visitors. Would that sufficiently constitute liability?

my above neighbor refuses to put down carpets to absorb the noise coming from his apartment. It so bad that my apt. trembles everytime he and his family walk around or play their stereo. I tried to resolve it by talking to them, but they chose to ignore me. Moving in New York City is really pricey and my place was a deal when I moved in six years ago. I can't afford to move right now. I've contacted the management company over and over and they also chose to look the other way. They claim that if I don't live in a condo or co-op building that they can't really do much but sent a nuisance letter to the tenant. The rent lease clearly states if a tenant is constant nuisance they could be asked to leave. But no one at the management co. seems to care about that or my problem.

because we work in a voluntary aided roman catholic high school, it seems that they can opt out of the equal pay settlement, lancashire county council asked my school 2 opt in the scheme, and they said no, if we worked in a state school we would now have a settlement package, like everyone else, do we have a case?

i work for this attorney who got his lisence to practice law taken away for 90 days, he is using another attornies name for the time, even some of the local courthouses know he's doing it and are ok with it. that disgusts me. I want to turn him I dont want him to know it was me, not because i'll lose my job, but i don't want any bad blood since he is also a longtime family 'friend'. I would normally mind my own business, but he is a egotistical jerk and he rips so many people off and he deserves to be punished.

I'm trying to find details on changing a minor's last name in the state of TX. My ex g/f and I just had our final court hearing but did not request name change during that time. Paternity has been proven by DNA test last year. My son, his mother and I would all like to change his last name to mine. Does this have to be petitioned by the mother and taken before a judge again? Or is there another way around this since we all agree it is in the best interest of our son?

Does anyone know Idaho law -- or even more specifically -- Ada County -- at what age will a child be allowed to have an opinion on how their visitation is divided? Currently, my children have to spend the entire summer with their father across the country. They dread the end of school because they know summer is coming. How old do they have to be to be heard?

I know a friend and she was raped by her ex-boyfriend. Although criminal charges are at works, she always tell me that at times she may still forgive him because she really enjoyed their sex lives before. Although she was REALLY raped, she still thinks of it. What should I do to her to make her realize the gravity of what his ex had done to her and her family?

Little or no crime, a job for every one, no junkies or over crowded prisons. Punishment fits the crime.
No out of control youths, inner city thugs with big guns.
Safe to walk the street at night without fear.

But...
No free speech, limited chosess, no vote.

I wish you could mix both communism with democracy...
Free speach, able to vote, Punishment fits the crime, you kill some one with a knife you die by the knife. Prison is a punishment not a holiday and if work is available you work and if you dont, no money, you can starve for all i care..Sorry getting carried away...

What do you think?

If prison was a real deterrent, maybe we would have less crime. I think we need a return to the kind of criminal justice systems we had before the arrival of the political correctness and human rights brigade. If someone is convicted of premeditated, first degree murder, they should spend the rest of their natural life in jail. No parole, no early release, no time off for good behaviour. What reprieve does the victim get?
And when in prison they should be made to spend half their time locked in a cell with no tv etc, and half of it doing labour.
Punishment should be punishment. What is so wrong with making prison a harsh environment. If you are there, then you deserve to be. Prison as it is today is no deterrent to a hardened criminal.
