my above neighbor refuses to put down carpets to absorb the noise coming from his apartment. It so bad that my apt. trembles everytime he and his family walk around or play their stereo. I tried to resolve it by talking to them, but they chose to ignore me. Moving in New York City is really pricey and my place was a deal when I moved in six years ago. I can't afford to move right now. I've contacted the management company over and over and they also chose to look the other way. They claim that if I don't live in a condo or co-op building that they can't really do much but sent a nuisance letter to the tenant. The rent lease clearly states if a tenant is constant nuisance they could be asked to leave. But no one at the management co. seems to care about that or my problem.

call an attorney and they'll tell you quickly if you have any kind of case. Excessive noise is the domain of the police department and you should be calling them. They'll stop by, listen to the noise, and tell you either it's a noisy building or they'll visit your neighbors and tell them to quiet down or face a citation.

Walking across the floor would not be considered a nuisance, but constantly loud music would be, and the management company has to enforce the terms of your (and their) lease, or you can take them to court to do so. The problem is, it's New York City, and what is a nuisance in Podunk may not be nuisance there. Consult a local landlord-tenant lawyer or information resource.

i'm having an same concern. This 4 scholars moved downstairs from us a month in the past (we moved into our apt. one monthe till now them) and they are up in any respect ours of the evening making undesirable noises. They talk large loud, it feels as if they were in our apt. They re manage fixtures at 3am and they under no circumstances close up. We also awaken very early interior the morning so it is change right into a issue. What we did became to confer with the owner. (i imagine is what you need to do first.) she advised us that she couldn't do some thing about it ( she did not opt to do some thing about it in reality) so then we talked to our stressful associates. they suggested they were sorry and they might give up...they did not! so we gave our word to the owner. we are able to not take it so we are transferring. For now we in basic terms bang the floor at the same time as they make noise ( we stay upstairs) and we make obnoxious noises interior the morning at the same time as they are sound asleep. they have gotten somewhat extra suitable. in some situations chatting with the associates or landlord works, in my case it did not. i imagine it is about elementary curtesy. i'm particular they does no longer experience free in case you've been disrupting them. In my city there're guidelines about noise stages. From 10 pm to 7am you could't make loud noises. If someone calls the law enforcement officials on the "noise makers" they receives fined. So the subsequent time they are obnoxiosly loud we are able to call the law enforcement officials for demanding the peace. And the week till now we pass we are able to supply them a authentic flavor of their very own drugs! you need to attempt it, i comprehend vengance is undesirable, yet in some situations it makes you experience extra suitable! :) I propose it is in assessment to we did not attempt to remedy this in a civilized way....

No but check out your local laws. there may be a noise ordinance that after a certain point in the evening you can call the police to compel your neighbors to keep it down.

The above neighbours may not be on the same lease as you, so they may not have a noise clause in there..

Yes you can. You have a right to 'peaceful enjoyment' of a rented property.

You can also report the neighbor to the city - they will have a noise abatement department that will take action directly against the neighbor.
