Down in the ghetto of detroit, where I work, this asshole cut me off, flipped me off, cut me off, and when I pulled up next to him, (with all windows down) he hocked the hugest lugie in my car which landed on my arm and hand, I was mortified and disgusted. This is not kids on a playground, this is an adult with some serious problems. That is disgusting and totally uncooth.

I guess maybe something but it might be easier on your head to just let it go. Unless he harmed you. After all, you sue when you have suffered harm resulting from abuse or negligence that has caused you life difficulties.
I know this isn't the answer you want but you'll find suing for a frivolous reason very taxing, time consuming and not at all worth it.

This is assault an the person can be charged with that but also if you do press charges you need to express the fact that the person could have a disease that you could now have an that the court need to make them be tested at their expense an if any thing shows upon the test charges need to be filed accordingly They put people in jail for attempted murder for having sex if they had aids it isn't any different if they spit on you an they know they have a disease that you could possibly contract. For your own peace of mind get tested an good luck.

Without stating which state you are from it's not easy to cite your specific laws.
However, in my own state the offense is:
Menacing.
(a) A person commits the crime of menacing if, by physical action, he intentionally places or attempts to place another person in fear of imminent serious physical injury.
(b) Menacing is a Class B misdemeanor.
(Acts 1977, No. 607, p. 812, §2110.)
or:
Reckless endangerment.
(a) A person commits the crime of reckless endangerment if he recklessly engages in conduct which creates a substantial risk of serious physical injury to another person.
(b) Reckless endangerment is a Class A misdemeanor.
(Acts 1977, No. 607, p. 812, §2115.)
If there is a serious medical problem with the offender such as the AIDS disease. Then the offense can be upgraded to a potential murder if the victim should contract the disease and succumb to it's effects.

If every kid on every playground that ever spit on someone was going to court we'd have craziness. This is just learning to get along, apologize, forgive....kindergarten stuff. If the spitter is not in kindergarten, feel sorry for their stunted emotional development and try to avoid the line of fire. They will someday wonder why no one will get within a few yards of them.

Assault and battery in most common law jurisdictions. In Virginia, add a count for "insult and outrage," it's a separate tort from the assault and battery.

It is a form of assault, but hard to prove because there is no mark. I am assuming that he spit on you on purpose.

Technically, it could be assault. His spit actually touched you, so technically it could be...
Just call the cops...He'll at least get fined for disorderly conduct.

You can call the cops and have them arrested for assault. Did you keep the evidence?
