because we work in a voluntary aided roman catholic high school, it seems that they can opt out of the equal pay settlement, lancashire county council asked my school 2 opt in the scheme, and they said no, if we worked in a state school we would now have a settlement package, like everyone else, do we have a case?

It's not clear from your question what the 'scheme' actually is; but it is not possible to opt out of an employer's obligations under the Equal Pay Act.
It is perfectly possible for a state school and a voluntarily aided shchool to have different pay structures, but that does not affect the obligation (within the school) to comply with the EPA.

Who pays you? I bet it is the Council if so they are not exempt they are lying. If it is the school I do not know but again I think they are pulling the wool over your eyes. Prepare for a bumpy ride

equal pay issue revolve around discrimination yes?

is it only discrimination if you work in a state school?

I would think you have a case if you have a case, it doesn't matter where you work.

attempt writing direct to the council and in case you get no success then bypass and bypass on your CAB place of work. You worked for them, and you have been underpaid so consequently you will desire to be entitled to the backpay - ~good success
