I paid some debts with no intention of filing bankruptcy. I was trying to settle on a car accident claim, but the other party decided to sue rather than settle. This pushed me into bankruptcy 2 months later. Now the Trustee in this case is claiming "Preferential Treatment" and requiring me to pay this amount to the estate because a debt was paid within 90 days of filing. Doesn't the intent have any bearing in this case? There was no "Preferential Treatment" on my part, as I tried to resolve my debts without bankruptcy, but had no alternative after I was sued. I have records to prove that I retained an attorney to settle the accident prior to being sued and filing bankruptcy.

I didn't have anything so drastic as losing a testicle, but he apparantly snipped and cauterized a blood vessel on the left side. He did call me and tell me that the Pathology lab said that the test specimen was not a piece of the vas deferens, but may be a blood vessel.

I went for a semen analysis and the results said that I had a lowered sperm count, but could still get my wife pregnant, so clearly, he cut the wrong tube.

As a specialist, he should know what he is doing, and a vasectomy is not a difficult proceedure. What legal recourse should I seek? He offered to go back in and fix it, but I don't trust him any longer.

In continuation to my other question, I thought it was my rebate money back into my acct. I WASN"T aware of how a rebate worked on a vehicle. I thought it was the same as if you bought a product from a store. Send in proof of purchase and get your money back. That's what I thought and that's what I did. Then a month later the money was back into my account along with my payroll. So I spend the money over the weekend. I receive a call 5 DAYS LATER from the car company letting me know of THEIR error. I told them the money was already spent because I thought it was my rebate. It wasn't a manager telling me this it was a regular employee (she sound like she was tryna cover her *** on the phone) She not only made that error once but twice cause she deposited another 1000 into my acct. That deposit I DID NOT SPEND because she told me in a timely manner but the first time was 5 DAYS LATER, and AGAIN I THOUGHT IT WAS MY REBATE. My purpose was never to defraud this company.

This happened in a small town near where I live. A bus driver was taking kids home from school when she smelled pot. She stopped the bus and asked them to confess. No one would. So she sat back in her seat and drove to the police station where they searched everyone on the bus. They found 3 knives, the pot, cigarettes, and lighters. Now some of the girls, who are about 12 years old, are saying that their rights were violated. Their parents are really upset about it. How would you feel if this was your child?

If we had a law with NO exceptions, that anyone found drunk driving (.08+) looses their licence with NO forgiveness of returning their driver's licence PLUS driving on a revoked licence would carry a MINIMUM of 6 months house arrest time (no house, time for prison) ADD to that your car is immediately impounded and your car insurance cancelled not to ever be reinstated. Do you think people would think BEFORE they drink?

Too many people die on the roads from drunk driving, it seem that the lives that are lost are no incentive for people to get a cab. Perhaps if you jepordize their ability to get to work and their freedom with swift and harsh punishment, spending $50 bucks on a cab isn't so bad.

Lesser offenses would allow car insurance to cancel you.
What do you think about this idea?

they're always trying to fakely fool people like they're really being equal harassing celebs, come on, guess because celeb doesn't mean have high level corrupt connections, these wealthy girls in houston (harris county, last name Dunn) convicted of armed robbery gave probation and have to shelve books in a/c library and tutor, how come they don't mow lawns? like a david medina corrupt district judge put by rick perry and bush failed breathalyzer fake trial and dropped case; also a fed issue, robert blake's attorney even said county jails worse conditions and rights (worse for health, fed issue) than state and federal pens (hot checks worse crime than state or fed felonies), as anyone knows if Paris Hilton was related to a corrupt cop (child, relative or friend) wouldn't have even been charged as well as jailed, cops' kids worst delinquents and drug dealers (pushers) and notorious criminal offenders, that's a proveable fact

I am about to file for divorce & NEED to prove my husband is an alcoholic & will put our 3-year-old's safety at risk. I know most judges will rule the alcoholic can't drive the child or have him overnight, but I have no proof that my husband is a drunk!
He drinks at his home & doesn't drive much. He hides vodka in his laptop bag so he can drink at work, but hasn't been caught yet. Strangely enough, he is a brilliant IT director & very respected!
I know for a fact that he drink around the clock because he has physical withdrawals if he goes without alcohol one day. He physically can't avoid alcohol in order to have visitation since he gets violently ill, so I know he'll drink while caring for my son (even if the jugde orders him not to).
Since he has no DUI offenses & hasn't lost jobs due to driking, what else can I do to prove he is an alcoholic & that he will put our son's safety in danger?
BTW, he has driven my son while drunk...I just don't have evidence to show the court.

Someone I know owed me money for the longest time and finally signed a check over to me with the words "Pay To The Order Of: My Name" and then put his signature on the check to pay me back. I went to the bank with this person and cashed it right in front of him. When we were leaving, he said that he deserves $20 from this check, which he doesn't. He has now got the police involved and threatens to sue me. Have I commited any crime here? Since he signed the check over, didn't he legally give it to me? And he was there when I cashed it, so he can't say I forged anything. Please help me, thanks.

To: The Governament of the United Stes of America
From: The Citizens of the United States of America

We The People During the course of human history, there have always been wars, and despots who rule without care to the people they are supposed to serve. Over the preceding decades, history has recorded the erosion of an experiment so grand in scale, so beautifully conceived, that no other form of government in the history of the world could lay claim to the peace and prosperity that was in the original promise to it's people. We, the People of the United States, do declare that the current government no longer represents us or our interests. We hereby make the following statements:

1) The wars that you have pressed in our name, from Vietnam to the current Iraq War, were prosecuted in the name of furthering peace, freedom, and democracy. We know now that you have lied to us, and that these wars were perpetrated in the furtherance of corporate gain.

2) You have violated the laws of our country with your illegal wiretapping programs, laying bare our most personal and intimate moments and information about us, in order to further control our thoughts and movement, and to perpetuate the fear among our populace.

3) You have passed illegal legislation without the consent of We the People, in the forms of the Patriot Act, and the ensuing Patriot Act II. You have continually passed further bills and legislation, again without the consent of We the People, in order to dismantle the very Constitution of the United States, thereby depriving us of the protections that our forefathers had the clarity of mind to foresee.

4) You have plundered our nation's treasure by giving absolute power to a non government entity, ie; the Federal Reserve Bank. The issuance of money by a private entity who then sells that money back to us with interest has had the effect of enslaving us all to a worthless monetary system. You have further allowed for the removal of our nation's store of gold and silver to this same private entity, albeit for "safekeeping".

5) You have fostered and sheltered a culture of corruption in our nation's capitol city. Bribery and Lobbying are rampant, and have increased tenfold under your current regime's watch.

6) You have failed utterly to defend the sovereignty of the borders of the United States, and actually idly stand by as invaders from foreign lands cross our borders with impunity.

7) You have slashed funding for social safety net programs across the board, causing harm, sickness, homelessness, starvation, and even death to a great number of our fellow countrymen and women.

Because of these egregious acts we hereby make the following demands of you, our elected public servants:

1) Immediately and fully release and disclose all documents and information pertaining to the events on the 11th of September, in the year 2001.

2) Immediately declare a halt to the hostilities in the countries where our brave soldiers are dying and being maimed, not in the cause of freedom, but for the corporations unto whom you are beholden.

3) Forthwith and immediately cease and desist your illegal domestic spying programs.

4) Immediately and forthwith discard and repeal all Patriot Act legislation, along with any and all related bills.

5) We demand the removal of our nation's treasure from the custody of the Federal Reserve Bank, and have it returned to the people's depository in Fort Knox, Kentucky, and other secure People's depositories.

6) Immediately halt and cease any and all lobbying efforts by private entities seeking to influence our nation's policy by bribery and coercion.

7) We demand a secure border. We demand the halt of any plans to merge the United States with Canada and Mexico, forming the Greater North American Union. We demand that you withdraw us from the WTO treaties, NAFTA treaties, CAFTA treaties, and all other treaties that are destroying and outsourcing jobs from our country.

8) We demand the immediate reinstitution of monies to be allocated for programs for the poor. We demand the defense budget be re-examined and the money saved from cutting un needed defense programs be diverted to stop the starvation of children in our country.

We further demand the dismantlement of the "faith based" initiatives, as they have been proven ineffective and corrupt. These declarations are non-negotiable, and We the People make these demands in good conscience and with conviction. We state further that should criminal activity be discovered, that the perpetrators be brought to justice, regardless of the office he or she may hold at this time. We the People remind our government that dissent is a right guaranteed to us in our forefather's framework and we exercise that right here and now with these Statements and Demands.

Written and Signed this day, the 13th day of October, in the year 2006.

Okay, so here's the deal.

My semi friend had just taken me to grocery store (after having paid him to take me there) and we pulled up in front of my dorm. There was no direct loading zone in front, only fire zones and handicap spots, he chose to park in a handicap spot.

From there I told him to wait in the car in case someone came by to check, and that it would take me two trips to bring my stuff up. He was impatient (he didn't have to be anywhere, just didn't want to wait) and decided to take the other half of the stuff up with me (After I warned him against it).

We took the stuff up and were down in less than 3 minutes to find the parking people taking a picture of his car with a $360 parking ticket on his windshield.

Now he expects me to pay half, which I think isn't right. What do you guys think. Should I be paying half? Less? None? More?
