I would take him to court for him to prove he bought it.
Normally Lottery tickets have the code on them as to when and where they were bought.
As long as you remembered where and when you bought it, he probably wouldn't know where and when you got it.
That way you could prove that you were the rightful owner of that ticket.

In CA, the ticket is track-able to the establishment where it was purchased, including date and time. To claim a high end prize, a potential winner must have a meeting with lottery officials. If this potential winner doesn't know where and when the ticket was purchased, an investigation will commence. There has been a similar case where the ticket ended up in the wrong hands. After investigation, it was found out that that person was not the legal owner of that ticket, and he was subsequently charged with theft and fraud.

It would be a matter of proof. If you could show, by a preponderance of the evidence, that you purchased the ticket in question and it was stolen it would be yours. Evidence would include records from the location where the ticket was sold, prior ticket purchases by you and the person claiming the prize, other items stolen from your house, was there a police report etc. None of these things alone would be definitive, but you would build a case and submit your evidence just as in any other case.

Unless you had proof you bought it, you'd be out of luck. And it would be your fault for not finding a safe place for it. Are you really going to leave a $10 million ticket that's an easy find? I'd cash it in the same day !

Wow......what if a meteorite hit the villian on the way out the door and vaporized the ticket and the thief? What are the odds you say, about the same as the other scenario I'd say!

In this day of technology please remember that most lotto sellers will have video tapes of transactions at their locations and they get it cut as the seller so there's a way to prove you bought the ticket and when. Just my two cents worth.

you are screwed - lottery tickets are bearer instuments - he who bears it claims the prize. to protect yourself in the future, sign the back of a lottery ticket as soon as you purchase it (and make a photocpoy, if you can)
