In continuation to my other question, I thought it was my rebate money back into my acct. I WASN"T aware of how a rebate worked on a vehicle. I thought it was the same as if you bought a product from a store. Send in proof of purchase and get your money back. That's what I thought and that's what I did. Then a month later the money was back into my account along with my payroll. So I spend the money over the weekend. I receive a call 5 DAYS LATER from the car company letting me know of THEIR error. I told them the money was already spent because I thought it was my rebate. It wasn't a manager telling me this it was a regular employee (she sound like she was tryna cover her *** on the phone) She not only made that error once but twice cause she deposited another 1000 into my acct. That deposit I DID NOT SPEND because she told me in a timely manner but the first time was 5 DAYS LATER, and AGAIN I THOUGHT IT WAS MY REBATE. My purpose was never to defraud this company.

It was her mistake and the reason she was calling you personally was because she was reprimanded by her boss. She probably was told that she would have to personally make up for the lost money if she couldn't get it returned. You are not liable for her mistake.

i think u can sue for emotional suffering and negligence. u thought it was ur rebate therefore u did nothing to detect any form of fraud.......the car company should have noticed this error no later than the very next day and notified u. moreover the incident happened twice by the same employee.......u have a good case and with the right lawyer (but i dont think u need one) this will prove that u do not have to pay that money bk with any penalties. u should only have to pay bk the difference of the amt u were supposed to get bk if the rebate was more than what u were supposed to get.......

Sounds like "Mental Duress" to me. I would lose my ability to think and spend "All" the money and stop making payments on the car, until they provided me with psychological counseling to help me understand "What's Really Going On"?
