I filed a lawsuit in Miami, Florida for damages, allegations of misappropriating funds, false name usage, harrassment, theft by deception, false billing. I asked for a trial by jury in my initial complaint and the "flurry of motions" is running its course. Now, I have a date for a "motion to dismiss" filed by the attorney(s) for the defendant and I will need to argue that the case not be dismissed and move forward to jury trial.

HOW or WHAT do I do in regards to "arguing" that the matter NOT be dismissed?

I know two people who have been required to submit photographs with their applications, one for a job, one for a medical school. I suspect this is not legal. Can a LAWYER please confirm or deny this? Also, assume that in both cases, looks are theoretically unimportant; that is, the job was not modeling, acting, etc.

The neighbor's tree fell down onto my car and part of the house.
He refused to say that he was at fault.
He said I should claim my own insurance.
It's absolutely not my fault. I parked my car on my own parking lot. His tree was huge and there was a strong wind and knocked down the tree. I told him before to take care his tree.
Is he responsible for this? What can I do?
Please help. I'd appreciate it.

Why are yahoo answers people such puss*es? I mean really yahoo helped the Chinese government track down dissidents so the government torture and kill them. But it bothers monitors if you talk about rape. What's up with that? Is it ok to brutally torture political dissidents and sell their organs on the open market but not ok to talk about rape in an open fashion?

I guess murder, torture, and life long imprisonment for speaking out against the government is cool with yahoo. But talking about sex isn't. Yahoo your priorities are really messed up.

What a bunch of idiots. Not to mention that my best answer percentage is 20% right now. Which is unprecedented. You know I’m very knowledgeable about: economics, finance, and the military. And I have the stats to prove it. So if I keep getting account cancellation notices because I say the word pu$%y or talk about rape then it will be yahoo's loss. I don't see many other people giving meaningful answers to the hard questions.

An ammendment to the Consititution was proposed that would have made it punishable to hold a title of nobilty (ie duke, that sort of thing). The punishment would be loss of citizenship. The ammendment was only for the punishment. The Consititution already said that it was illegal to hold such a title.

If passed would have been the 13th ammendment. It came close to ratification, but due to upsets caused by the war of 1812 (burning of the white house and many congressional records), it is not entirely certain whether it was ratified or not. Do you think this ammendment was sabotaged?

I live in San Antonio,Texas. I have to go to court for child support for a review(after 3 years). Does it matter if he has another child? Does the child mother have to put him on child support to make a diifference? Does it make a difference if they are not married? Also do they pay more if they are married? Does the court see both of there income as one if they are married, if so would he have to pay more? Please help.

I have a friend who lives in a US state where the legislature has passed a law providing for the death penalty in statutory rape cases. He is afraid that someone will hire an underage girl to "service" him while he sleeps, then yell "rape" after the fact. He also wonders if that happens, if he's headed for the gas chamber anyway, whether it would be better just to kill the girl and hide the evidence. What are the best options under my friend's hypothetical situation?

If you made drugs legal:
1)it would free up the prison system. you could release everyone there strictly on drug charges, so that we would have space for violent criminals like child molesters.
2)it is the last frontier for a tax base. think if all the drug money was taxed and put toward organizing rehab programs.
3)people selling drugs could pay into the social security system and have some form of retirement.
finally, do you think if the gov. legalized drugs that people that don't do drugs now would start???like there would be an onslaught of drug use because all of a sudden it was legal?????

my gf has recenty gotten out of highschool and is taking a summer course to become a CNA but she needs to commute to a city that is closer to my home than her current residence and thigs aren't going well at home so i want to know if her dad could sue us if she were to trip and fall down the stairs or something accidental like that my dad won't let her move in until he knows that he won't or can't be sued by her dad

I was arrested along with about 50 other people who showed up to court and eneded up in jail because we were not informed prior about paying court fees.Basically th desk deputy was giving out legal information to everyone and after you go befor the judge you go to the back and if you don't have money they throw you in jail. Mind you I knew about this court day for one month an dI was not sent any type of document stating what I had to pay and when or nothing.
