I live in San Antonio,Texas. I have to go to court for child support for a review(after 3 years). Does it matter if he has another child? Does the child mother have to put him on child support to make a diifference? Does it make a difference if they are not married? Also do they pay more if they are married? Does the court see both of there income as one if they are married, if so would he have to pay more? Please help.

if he has another child he can ask for a reduction on your children....no difference if they are married...only his income is involved in your support....no increase if he is married ...his new wife income has nothing to do with your kids

Hi. I used to work in Child Support Office .......
the main factor that will determine any adjustment to you current support amount will be the father's income, but the court will also take into consideration what his expenses are,
so if he has an additional child from another mother that he is obligated to provide support for the court would take that into consideration to determine an appropriate total amount for him to pay.

they will give him credit for another child if the child is his own. it doesnt matter whether they are married or not. his income is the only one that counts. he will also get credit if he pays for the childs health/dental insurance and credit if there is any child care involved that he is directly paying for. it basically boils down to income. by the way you do not need an attorney for child support, your local child support agency represents you. ie they are your "attorneys" and they are free.

Of course it is different everywhere, but here in Louisiana, if the domicile parent does not work and is married, they use that as part of their income. If the non-domicile parent works, they will only use that persons income even though he/she is married. It does not matter if they have other children or not.

only his income is figured when looking at child support for your child. doesn't matter if he has another child. child support for his new wifes child shouldn't effect yours either. bottom line...hire an attorney to make sure that your best interests are represented.

Whose child?
Who is the Mother/Father?

You might want to ask your attorney all of these questions BEFORE you go to court. That way you are prepared!
