The guy rear ended my new car that I just purchased 8 months ago. What are my rights? My insurance company is going out to determine if it can be fixed, however, the car is totalled..I'm making his insurance pay. Should I sue for damages? My main concern is that I was slightly upside down with my new car, and I just don't want to recieve a check of the value of my car ($16,000) when I still owe $18,000 and go through the fiasco of coming up with a down payment. Will his insurance pay out the value of the car, especially damages? I told my insurance company I had a headache after hitting my head.. Has anyone experienced this?

We hit black ice in our mini van and the insurance is wanting to total it. Repairs are about 6,800 we owe about 10,000 and the blue book value is 6,500 to 7,000.

I have a car that I am still paying off but I want to get my name off it from financing since it is my daughter who uses this and the dealer just used my credit to buy it at that time because she was only 17. Now that she is 18, can I make it appear that she bought the car so she can make the payments and that way have the title transferred to her. Or do I need to consult a lawyer?

I have a smashed windshield with a $500 deductible. If I get someone to fix it (for a lot), can I write off my payment of the deductible on my taxes next year, or is it just called the deductible because it is deducted from the total cost of the repair?

My 16yr old was involved in an auto accident. She was going straight on a highway and another car was making a left turn and turned in front of her causing my daughter to hit her car. The other driver was issued a ticket for careless operation. A car behind my daughter was a witness to the accident along with a passenger with my daughter. The driver at fault was a 78 yr old lady that was with her 80 yr old sister on their way to a casino. They are fighting the ticket saying that my daughter was speeding and didn't even use her brakes because there were no skid marks. This was 8:30 pm and it was dark. They are also claiming that the elderly sister had injuries. But, when I asked if they were ok, they did mention the sister bumped her head on the window upon impact but she was ok. They also stated that she had an aneurism(sp?) 4 mos before. The police report states that my daughter was doing the speed limit and that the driver behind her did see her brake lights. Can they win?

So my son got pulled over and issued a dui in washington state. It is being negotiated to a driving infraction as they didn't have a case for the issuance of the dui. But the dol is most likely still going to suspend his license because he refused the breath test based on counsil advice. Question: Without a dui conviction, what will the suspension due to his insurance? Will they even know about it?

My car is parked near my house, at the end of the road. It has been there for several months now. A few months ago one of my neighbors backed into it and smashed the driver door in. He decided he wanted his insurance pay for it. I got his info, but procrastinated and never called his insurance. Can I still collect money from the wreck or has it been too long? I need to know because I'm trying to sell it.

Hi, I am working in a public traded company as a student employee. I only have G1 license and I don't have a valid parking permit in the company 's parking lot.

One day, I just want to park the car in the parking lot for a while. I accidently put my foot on gas instead of brake. The car hit one side of the buildng.

As far as I can tell, it only hurt the protection layer (just plastic stuff that prevents heat leaking out I guess). The pipe became visible.

The company's facility department will get me the damange cost early next week.

I already sorted out other things ,like fixing car, driving without G2.

My biggest problem is how should I deal with my company ?
If the company's insurance agent send me a bill which I can't afford, what can I do ?

Please help. :--(

The insurance company told me the car was totalled. I paid $3000 while I purchased it (I got it in Jan.)
According to the kelly blook book value it is estimated at $5500. But while I transfered the title, we agreed to show it as $1000.
Now I dont know how much should I ask the insurance company to pay me? How much can I ask them and how should I ask them. And how much they will give me?
Any idea?????????
Any help please.

I got a ticket in April of 2004. I paid the fine and went to traffic school.
Just two days ago, i got a ticket for speeding (48 at a 35 limit).

1) will I still able to go to traffic school for this ticket? (I'm in CA, my friend told me we are allowed to take traffic school if it's over 18 months since the last citation, is this correct)?

2) i read some yahoo answer on car insurance and someone is saying the insurance company will still able to view the previous citation and raise the car insurance if we get the second citation within 3 years of the 1st one. the point will be unmasked for insurance company to see. is this true?

3) if it is true, does that mean even if i'm able to go to traffic school for my second citation, the insurance company can still raise car insurance for my 1st citation?

After a minor car accident, what do you have to do? Do you exchange insurance information with the other driver? What do you do with this information? What if you don't agree on who was at fault? Is calling the police always necessary?

Re - the two quotes supplied - for the wrong vehicle. The person who I hit is a spouse of an insurance agent!!!!!....who, as it happened.....was in the car at the time. Don't you think it amazing they would send me quotes for the wrong cars?
I am happy to pay, and no one is advising me not to pay - but I can't agree to pay for quotes given with the wrong Vin# or wrong model year.

I was thinking of getting 3rd party insurance on a cheap car, and driving my parents Mercedes, which has fully comprehensive insureance. I'm not bothered about weather it covers the costs if I damage it, just as long as the police don't stop me.
