So my son got pulled over and issued a dui in washington state. It is being negotiated to a driving infraction as they didn't have a case for the issuance of the dui. But the dol is most likely still going to suspend his license because he refused the breath test based on counsil advice. Question: Without a dui conviction, what will the suspension due to his insurance? Will they even know about it?

Clarification: My son is not expecting the dui to stand, but rather a lesser traffic infraction. He will not have a dui on his record. The question is really about the suspension for not taking the breath test, will that show up on his insurance?

the suspension will show, nationwide, on his motor vehicle record. the insurance company will run his MVR every year. theyll know. it will effec t his premium. in ca it will effect him for 3 years.

A child support suspension (the above response) does not reflect upon your ability to drive.. only your responsibility. So it does not change your rates.

BUT.. a DUI on your record will, eventually, be noticed by the insurance carrier and you can expect that there will be some sort of increase.

You can always exempt your son from driving. That will lower your rates, but your son will not be covered for driving (a VERY risky effect if you think he might take the car anyway).

In Ontario refusing to provide a breath sample is punished the same as if you blew over the limit. You'd be looking at a 1 year suspension. Most insurance companies would drop you like a hot potato and force you into the Facility Pool, with rates over $4000/year for basic coverage.

In missouri the breath test refusal shows and would cause a one year revocation. It would require an sr22(proof of insurance) at the end of the year to get license back. This would put him in high risk insurance for several years. I would ask the lawyer what the advantage of fighting the dwi and spending all the extra money when the same thing is happening to him even though he was found innocent. I've seen this happen many times.

well im not sure if this will help but my licence was suspended because of child support but my insurance or registration had not been efected and i dont think it would untill renewal.im also in new york state..and still driving ..ok hope it helps steve
