Say Joe is elderly and has dementia. And say Bob is distantly related by marriage. Bob was originally going to share a small portion of Joe's estate, as outlined in the will and life insurance policies that Joe drafted before getting sick. But since Joe developed dementia, Bob has influenced Joe to change his will and life insurance beneficiaries so that Bob will get half of everything. It's clear that if Joe were lucid, he would not have wanted this.

I know that this is undue influence, but is there anything criminal in what Bob is doing?

Ive been scheduled to have a meeting with the local HUD/housing officials. It's an extremely important meeting. I requested a sign language interpreter. I called the independent company I was told to and requested an interp.
Just heard back from them. There are no interps avilable for me on the meeting on Wed. They have RESCHEDULED ME for April 11th. They didnt have my permission to reschedule.

I am furious. I feel like I am being shuffled around like a piece of furniture and my appointements are being changed to suit everyone else. I say I have final say in ALL aspects of my life and nobody changes my life without my permission.
Isnt there a rule about the federal gov needing to provide an interp within like 45 minutes?

It would seem to me that attorneys should be given fixed terms of say six years and that there should be a rotating appointment where all of them cannot be appointed at one time. And they cannot be fired without due process.

Without something more...basically it gives the Executive branch the ability to investigate and shut down investigations at will.

What do you think?

I wrote a check to a Wal Mart back in late 2001 that bounced. Because I was laid off from my job in the airline industry right after, I was unable to pay the check until Wal Mart had a warrant put out for me. I found this out when I went to the store to pay it back in early '02. I paid the fees, and restitution to the courts and plead guilty to simple worthless check. My question is, does a misdemeanor such as this get expunged from my record after a certain period of time, or do I have to ask to have it expunged. This has affected my ability as of late to apply for a few jobs that had nothing to do with handling any kind of money. Serious answers only please. Thanks.

First off, I DO NOT want to discuss whether the ban is right or wrong. Any such posts will be ignored.

My point is that technically pubs and clubs are not public places. Sure they are places where members of the public CAN gather, but only at the discretion of the landlord. By this token, I can invite members of the public to a party at my house for example and yet they will be able to smoke unless expressly told not to by myself. Should this not be the case for landlords also?

I'm all for protecting people's rights etc, but surely if a landlord wants to protect his buisness (certain pubs are frequented my higher percentages of smokers than others) then should he/she not have the right to apply for an exemption?

There are many "holes" in the legal working of this ban and I just wondered what everyone else thinks.

Live in Sav'h, GA, was flooded in home rental(lived in 9yrs), lost so much. City's drainage pumps shut down, home had flooded many times before. So, w/all attorneys in yellow pages, how do you find one that's willing to take on this, w/out having to pay up front? being on disability doesn't give me much $$$ to hire one. Tks, and God Bless for the advice. What are points for on this site also? This happenned past July, Red Cross helped as much as possible, but still trying to make ends meet by paying for lost utilities, all that Red Cross could not cover. Flood house has been sold since then, but know landlord made kickback from Ins. Co., and would like to know if he benefited from any of things we lost from his Ins. Co. and do we have option to sue him also, since we didn't know in beginning that it was a flood home?

ok.. well 4 years ago, I shoplift at Old navy and got caught. ON that day I just turn 18 too. Well On that day, the guy that caught me stealing had ask me to give him any identification card that i had with me. So what i had with me is my 2 years old school ID. I'm not sure if he notice the year on that ID and what he put down but he didn't press charge me going to jail. A cop came in to take me in to get my photo taken and fingerprint only. Then 4 weeks later, a letter was sent to me and I had to go in for an orientation about shoplifting.. so that was pretty much about it. I was glad that I didn't get charge or had to stay in the juvinile hall . that will be so embrassing. So I was wondering if you turn to age 18 will the put you in jail or what. Then it will probably depend on that person who caught you how he wanted to press charge you right? Will it shows on your credit report because I check mine and there's nothing on my background? Please respond...thanks.

I don't understand just what you are trying to do? If you close down circuses, rodeos, and zoos. Where are all the animals going to go? If you don't like the living situations some of them are in why dont you team up with the orginazations and donate some of the money you raise to build nicer facilities instead of bashing them all the time? Do you have a place where you take care of animals? or why dont you spend some money getting the law makers to send them back to the wild? or do you even know it is against the law to send them back?
The bad press makes you look very uneducated.

Ok here is the situation I'm in right now. I bought a wrecked vehicle from a dealership with a Certificate of Destruction from the state of Florida. I understand all that is implied with that kind of title and that it needs to be inspected. I live in the state of Ohio and it is legal to get it inspected and get a self assembled title issued to the car so it can be driven around on the street. So I fixed the car up and set up an appointment at the local state highway patrol office only to find out when I get there that they wont inspect it. Reason being the company did not put the title in my name. The car was not registered in the Companies name from the get go, there for they did not sign it over to me. I called them and told them what happened and they told me to give them the title. So I did about 6 to 7 months ago. Every time I call them (3 or 4 times a week) they continue to tell me they are working on it. Nothing has been done and all I get from them is lies. What should I do???

ok, i uploaded a photo and sent it into a contest not thinking that it would be chosen as one of the photos to be published. i got a letter saying that i have to verify that it's my copy righted. although i'm not the one who took the photo, i have my friend's (the one who took the photo) permission to send it into the contest. is that wrong? becuase, the photo will be published under my name, not my firend's. should i include that in my statement (that my friend gave me the pemission)? or should i not say anything? i'm not intending to get all the credit for this.

but it is not illegal for a child to act out in school disrupting other kids education.

I don't want you to blame it on child mentality because if it is 5 out of 20 children acting out then it is not due to mentality or age... It is due to them knowing they can get away with it. Children know right from wrong, and they also learn what they can get away with.... IT'S CALLED OPERATE CONDITIONING!

If you go in a store and steal something (like put it in your pocket or purse) and then make additional purchases with a credit card, and someone later sees you commit the crime when reviewing security tapes, can the store track down your personal information from the credit card company and have you arrested?

My b/f and i broke up about 3 weeks ago because we were not working out. The understanding was that even before we broke up he was to come see him whenever he wanted and to pick us up on weekends because iam breastfeeding and we both agreed that breastfeeding was the right thing for our baby since we saw how bad of gas he had to the formula. Now he doesn't want me comming over on weekends so he wants to go to court for weekend just to hurt me and wants to give our child baby formula because his mother put into his head that he should not have to drive 20 minutes to come see his son. shes only doing that because shes not willing to come over to my house to see him. My son is only 3 months and i told them until i stop breast feeding prob in about 5 more months he will be over the ever weekend without me and whenever the father wants to see him. I dont see a problem with this i think they might try to secretly take me to court. What can i do to prepare what can they sy to take himfrm me

We just purchased a house and the tenants are on a year lease when we purchased it. The previous owners did not charge the tenants a pet deposit fee. Would we be able to go in there and charge them a pet deposit fee or would we have to wait for the lease to expire? We are in Texas.

I just got out of the movie, and was very impressed by it. I've always been a fan of "war movies" and/or anything with an historic/epic basis, but while I enjoyed this movie, it made me feel quite different. While part of me still wanted to be the brave soldier that dies proudly for his country, another part of me was deeply saddened that this type of thing STILL happens...any similar feelings, or is this just part of me growing up?

Ok on Janurary 1, 2007 i was convicted of a minor traffic violation (this was my second violation as a minor) I hired a lawyer to get the second charge dissmissed in court so i wouldn't loose my license; court went over very well the judge dropped the origional charge of "Reckless Diving" to "Improper Driving" which was fine with me b/c i still had my license.....about 2 months later i recieved a letter from DMV saying that b/c i had two traffic violations and i was a minor the my license would be suspended for 90 days (What didn't make any sence to me is that my suspention date satarted on my 18th birthday....so petitioned the courts to ask for a Restricted License....I went to court and the judge did grant me a Restricted Licens to drive to WORK ONLY! I'm a Senior in high school so i asked the judge if i could get a restriction to drive to school and the judge told me that that was not gonna happen. Is there any legal was to get around this?

My two grandsons were adopted from Russia. It is no secret, in fact the parents have already started telling the 3 year old about where he came from. But we have been warned that adopted children are treated differently, especially in school. It is really non of their business whose womb a pupil came from! It is illegal to ask race or gender on job aps, but are similar questions legal on school forms?
