Law & Ethics - January 2007

My sis and b.i.l. have had 2 kids taken away. The first under unproven allegations of abuse, and the second son never even got to leave the hospital - CPS showed up and took him before he was even 36 hours old.

My first nephew has been in CPS custody for nearly a year and a half (75% of his life) and 2nd nephew since he was born in November (didn't even have a chance to bond with his own mother). Sis's caseworker has even stated to them that they have no evidence whatsoever that substantiates the allegations from the first son, even though they have been sued by the state (and papers claim the state DOES have evidence.) Sis and BIL have done each and every thing the CPS ordered them to do - twice (parenting classes, counseling, etc.) Oh, and my sis is disabled. Not physically, but she is bipolar and has SSDI. Her doc's (3 of them) signed statements that she does not, at present, need meds 'cause she is stable, but CPS said she will never get her kids back without being on meds. Help!!

a former friend of mine is threating to call child services on me for no reason. we are going back and forth and she is getting on my nerves. now does anyone know of a site or someplace where i can go and file a report online. i live in pennsylvania.

This happened a long time ago but, my uncle and aunt were in the process of getting a divorce when he was killed. As far as I know he didnt have a physical will. But his stuff and money should have gone to family. However it was ruled that it went to my stupid witch aunt. My grandparents barely got anything except the flag on his coffin, his medals, and some other items. But things at his house, like his motorcycle that was supposed to go to my father, was sold by the aunt. Is this at all lawful?? I know it at least isnt moral!

I am writing a paper for my Business Law class, the professor said to write about something dealing with leagality. I asked my friend and he told me to write about the internet gambling issue. Since I am in New York I have to keep it related to N.Y. I found a lot of interesting points for my paper but I still cant get a solid answer, is betting online in new york legal or illegal? This question is pretty much the foundation of my paper and without it my paper would not be an A paper, thanks for all the help.

Ok so ill try to make this as short as possible. I joined the army as soon as i graduated last year at 17 im now 18 and my girlfriend who is 17 is 7 months pregnant. Her parents said shes grounded till shes 18 she cant talk on the phone, use internet, she cant leave the house unless her moms there. I found out that her mom told the doctor that it was a one night stand that they didnt know who the father was. Her mom has theese insurance thing going and is telling my girlfriend she needs to sign over custody to her so the baby is covered through the insurance. With only 2 months left i need to know what do do by going through the legal way or what to either get her out of there or make it to where ill be able to stop this custody papers? Also what i should do about her mom hating me so much i would rather be in this relationship with her parents ok with it? Any advice would be greatly appreciated.

ok ppl plz be patient with me ... i never done this ... facts she did not give any permission for them to go in and she can not ... she does not live there....there was no danger to make the police feel that someones safety was at stake..... and they sat and talked to her about her dad.... and never showed any ID to her me are him the whole time they where there and ... i asked what was going on and they told me everything about him and i dont live there please before you answer read other 2 quetions so you get the whole picture...they entered the home with an anonymous tip that there was narcotics there ... they didnt even know what kind! now this happened 7 months ago and they just now saying want to pursue it to a federal offense... because he had guns there legally bought and he has never ever been in trouble with the law

Last year I was the defendant in a civil Lawsuit the plaintiff won the suit and attached a Lien to my house.When the house sold I purchased a Bond from the escrow account and recieved the check from the sale. How long do I have to appeal the Judgement ? and can the Plaintiff get the money from the bond without my consent ?

My business is very small and I had to let go an employee due to very poor performance, bad atitude, theft etc.
The employee has now filed a workers comp claim against my company, stating he was Injured in October he was terminated in December and did not mention any Injury prior to dismisal. How should I proceed I have just recieved a letter from an attourney.
My company does not have work Comp coverage. Would this covered through the payrole taxes ? or do I not need to have workers comp because my company is so small ?

I had a friend that had about $50 took out of her lousy minimum wage paycheck when she worked at a convienience store. The reason why was because when gas prices increased, so did drive offs. And she was charged for the ones on her shift. I asked her if she signed an agreement and she said he just did it. Guess what? She filed a small claims suit to recover her money and got back the money, court cost and interest. An employer has to take you to court if they feel you owe them money. BTW the judge verbally slapped this guy around a bit which was the icing on the cake.

This one is as emotionally charged as religion and politics. Try to keep an open mind when responding. Think about the degrees of so called sex crimes. The worst are the molesters and killers of the innocent. If they don't kill them physically, they do it emotionally. Very sad indeed. What about the guy who is 18 and dating a 15 year old girl. In their 20's it wouldn't even be thought of twice, but because of skewed laws, he has to go through life as a registered "sex offender". Seems a little extreme in those circumstances. He is NOT a sexual preditor. He's 18 she's 15 and when he's 46 she will be 43. Now if he was 46 at the time of the act, then yes he is crossing a clear line. But give me a break on these teenage romances.

If you dislike the president is it ok to say "If I ever meet that man, I'll punch him in the face!" Is it ok to say that, because we have freedom of speech? or do you think you could get arrested for saying that? It's an empty threat and the person who said it did not mean it. What do you think? At a local high school in Texas, a principal is trying to enforce a displinary requirement that a student will be suspensed from school if they are tardy. Aslo this principal is trying to enforce a rule that a student that is caught sleeping in class will get expelled. So make comments and please give an answer. Thanks.

Do you think its true that no matter how much you have in life you will always want what the other man/woman has got?

In my experience if you do get it its usually not all you thought it would be and your still not satisfied.

Anyone else had any similar experiences? Why do you think this is?

he stated I was being sued from a bank i had a card with debt on it. He really yelled at me and said he was sending the cops over or I could settle this right now. he then said I had to pay ALL of it by 2 weeks and he was really belittling me and intimidating. then I told him my check routing number and check info and said I hope i can find the funds. He said "it better not bounce" or else. anyways I researched his name and can't find his name and he works for someplace called CCS. What to do? does that sound right? he basically gave me no choice and so I gave him my info but now I'm screwed I don't have that kind of money.

I was diagnosed with ocd severe, PTSD severe,bipolar disorder as well.I also have grand mal seizures for which I take 3000mgs of Keppra a day,Ive had 1 heart attack and have hung myself once.I also have a herniated disk for which they wont operate on me for because I have diabetes.I worked faithfully for 20 years,owned my own buisiness for three and always paid my social sec as well as medicare and Taxes.Now that I have become disabled every doctor I have has sent letters to ss
the govnt doctors sitting on thier lilly white @#$@# all seem to want to refute any evidence I present THESE DOCTORS KNOW THAT I AM DISABLED!so whats the angle? how much of a kickback are they getting?Why has my govnt forgotten me the average joe.we also have lost our home went bankrupt, but also are managing raising 3 children, the bottom line is what does my Lawyer have to do to beat these corrupt crooks?

Does anyone work in a call center or in customer service too?

Are we entitled to any rights at all?

I work in a call center answering general enquiries, and my manager wants us to "be professional" by allowing customer to scold us, yell at us, curse, threaten, they can basically say anything to us and we just have to accept it.

A customer used tons of profanities on me, i'm have to tolerate 'cos if i interrupt, try to explain or stop him then i'll be blamed by my manager for being "unprofessional" by disrupting the customer. Then the customer starting cursing at my parents!!! I kept my cool n firmly told her "please do not say that about my parents" n she YELL at the top of her voice "HOW DARE YOU BE SO RUDE TO ME, I'M A CUSTOMER, YOU STUPID!!! YOU ARE SO STUPID!!

One of my collegue was told "WHY DON'T YOU JUST DIE YOU'RE COMPLETE USELESS "...!!! I mean.. we're people too, i do understand in customer service we deal with difficult people but isn't there a bottom line?
