I have not yet spoken with the other person's insurance company, nor have i admitted to being at fault. Should I just wait until the insurance company takes me to court like my mother says?

brakes wouldn't stop. He tried to swurve so he wouldn't hit the guy's car, but he hit the guy's car anyway. My brother said the sun was so bright in his eye's it was blurry to see. My brother's car hit the guy's car. The guy didn't have insurance for his car. My brother was limping from the accident, nothing was wrong with the guy's car but my brother's car was totaled. Then the guy said he had to go to the hospital cause he was hurt, but my brother was the one limping and hurt his head. My brother should've went to the hospital but he got a ride home and is still limping. He said it hurts really bad, but he won't go to the hospital. What should he do about people who lie in the accident? Should he go to the hospital? and what will they say and do? What will his insurance say about the guy not having any type of car insurance? and then going to the hospital? I need help ONLY from lawyers who knows or people who has been through the same thing and got out good.

I will be out of the country for two years doing a peace corps type volunteer program, I am currently on my father's car insurance and don't own my own car. I pay about $400 a year to have the right to drive one of his cars. Is it worth cancelling my insurance for two years or will the uninsured penalty be worse. I am currently 22 and a recent college grad. Thanks for any help.

My car got hit by a garbage truck at home in my parking lot.Guilty party is offering to pay for the repairs by check w/o insurance company getting involved. Now,this just happened 24 hours ago and so far they seem to be cooperating just fine.Just in case they should try to screw me,how much time do I normally have to inform THEIR insurance company about the incident? Is it 10 days,14 days or 30 days???

I'm in the State of Hawaii and my car got hit by a garbage truck in my parking lot at home.Minor damage on the rear bumper.Guilty party seems to be cooperating so far.Claims to have left note on window, but it was never found. They claim, they took picures of the bumper and license plate.Am I not legally supposed to get a copy of their report, pictures, written statements (It's a garbage disposal business after all,it was their truck that hit my car) and what do I need to do next? And why do I have to go to do all the work, driving around to get estimates, for repair, etc. and what is the next step? Also is there like a website or a business I can contact about this matter, besides my insurance company?

Ok my car was in an accident and claimed as a total loss. I was given a rental car and to wait out the check. I didn't want to be without a car when the check arrive so i was looking for deals on cars and ended up buying one before recieving the check which they said was on its way. Now its feet dragging and sign this and that. I wanted to know since i have a car now and turned the rental car in can they pay me for me using my car? since i technically should still be in my rental.

I have a Triple A (AAA) Plus membership, I'm 23.
Been renting cars 3 times with Hertz in Ohio, and they never added me the under 25 fee.

Did they forget the 3 times? (doesnt sound likely)
Does the AAA membership always waive that fee?

Thanks

Just purchased first vehicle...a 2006 Honda Ridgeline! Last week while at work on an oil rig a Halliburton tanker backed right into it ripping the front grill off and putting a scratch on the right front rim. Halliburtons insurance agent just called and told me to go get a few estimates on the damage (probably around the area of $3000.00). I had planned on keeping the vehicle till it reached around 85,000 miles and sell it.....so here is my question. Now that they wrecked my vehicle is it going to show as wrecked or salvaged when they run the vin # when I plan to sell it. If so should I try to get Halliburton for all their worth and where should I take the vehicle for estimates? Whole in the wall body shop or franchised dealership? Thanks for your help!

A week ago when I was backing out of a parking lot I heard some horns honking, so I stopped in the middle. A second later an SUV backing out from the other side hit my passenger side rear panel with her bumper. We exchanged info, but she thought it was too much trouble to go through insurance, so she offered to pay me in private. However after see saw the $660 estimate she decided to go with insurance. So I filed a claim with her insurance company, 21st Century. Their adjuster looked at my car, and a few days later decided it was not her fault! One witness said both backed out at the same time and hit each other, and the other said I backed out and hit her. What happened was I saw her backing in my way, stopped and couldn't avoid her hitting me. I don't think the witnesses were lying, but they just didn't see everything. The estimate 21st Century sent me was at $890, which I didn't understand why they even send me one.
What is my best option? My insurance co. is Auto Club of So-cal.

I was headed to grab lunch and went through an intersection on a green light, some *** ran the redlight smashing into me. He was very nice at the time of the accident and because he was an 'older' man, I did not want to make the situation even worse, so I didn't reinforce the fact that he ran the red light and not me. We exchanged info and he gave me his insurance info and business card. He said, "If you have any problems with anything, give me a call."

Well, when I called his insurance about 30 min later, he had already called and told them I ran the red light. Long story short, I am stuck with the bill for my car ($4000+ ) and he walked away with barely a scratch on his truck! Oh, and by the way... he is a defense attorney and owns his own firm... so what can I legally do in a situation like this??

I failed my test due to 3 minors on hesitation when tunring out of a junction. The roads were busy and he told me i was waiting for too big of a gap (i disagree - but anyway thats not the question).

I am just wondering whether you think that hesitation should be classed as a fault on a drving test. Its not dangerous driving, and by waiting for a suitable gap i am no putting anyone at risk. If anything it should prove that i am not a boy racer. My drivin instructor told me that i will only fail for dangerous driving... how is waiting for a good gap dangerous?

I was in a car accident, it was not my fault, the person who crashed into me has taken full responsibility.
I had it for a year, it cost me $1800, from a registered car sale yard, it was a 1994 Nissan Bluebird, well maintained, tidy appearance recently warranted and registered. had just replace winscreen because of a large crack, bought 2 new tyres, and had a service done to it, costing me a bit, and have the paper work to prove it. I did not have insurance.
The other person was insured, and her insurance company decieded they would pay me out $1000, because it would cost $6500 to repair, no negotiating, take it or leave it.
To buy the same car, year condition etc, prices ranged from $2500- $4500, when i asked the insurance company for the minimal they refused.
For a $1000 i cant buy a reliable car, without putting more money into it.
Is it unfair to want my car back in the same condition prior to their client crashing into me? or a resonable pay out, to buy a reliable car.
