I'm in the State of Hawaii and my car got hit by a garbage truck in my parking lot at home.Minor damage on the rear bumper.Guilty party seems to be cooperating so far.Claims to have left note on window,but it was never found.They claim,they took picures of the bumper and license plate.Am I not legally supposed to get a copy of their report,pictures,written statements (It's a garbage disposal business after all,it was their truck that hit my car) and what do I need to do next? And why do I have to go to do all the work, driving around to get estimates, for repair,etc. and what is the next step? Also is there like a website or a business I can contact about this matter,besides my insurance company?

You are not entitled to any documentation/photos the garbage place may have now or in the future. If you want your car fixed, you have to get the documentation proving your damage--you have to have a dollar amount attached to it so they know what to pay. You are dealing with a business (or a 3rd party administrator), not an insurance company. If you don't want to deal with it then call your insurance and they'll take care of everything.

The tough part is it happened in a parking lot, and in most places a parking lot is a free for all. Getting them to cooperate and getting them to follow through are completely different things, unfortunately so can the right thing to do and the legal way. Best bet to leave for the insurance company, they will do what they can legally to get reimbursed. How minor is minor? I've taken out some ugly marks with a damp cloth and something mildly abrasive like Oxidol. then again replacing a bumper, mounting, aligning, and paint to match can run upward of $600-$1000. Really stinks don't it.

You need to get the driver's info from the carting co. and report them to their insurance company so you can make a claim for repair. Advise your insurance company that you are doing this. You should take pictures and get your own estimate for repair. Good Luck.

contact their insurance if you've been given their information....
the insurance will take your statement, and then tell you where to take it to assess the damage and estimate for repairs.....

they'll tell you right then and there what you're entitled to (and assuming you're the owner, and aren't paying it off still) will write the check right there. it's up to you to choose the repair shop if different from the one who provided the estimate...... and it's up to you to do the repairs, or pocket the money instead.

yes you are legally bound to obtain everthing, ie pics, statements from the driver, and copy the police report. but as for websites or other companies i do not know.

I dont get it.. whats so hard? all you have to do is call their insurance and file a claim. They will do an estimate and pay you.

first you need to contact your local police and see if there was an acksedent report filed and if the was you ars intitled to a copy of it for insurance reasons. if there was no report filed i would talk to my lawyer. it may be minor damage but the city is respoiable
