brakes wouldn't stop. He tried to swurve so he wouldn't hit the guy's car, but he hit the guy's car anyway. My brother said the sun was so bright in his eye's it was blurry to see. My brother's car hit the guy's car. The guy didn't have insurance for his car. My brother was limping from the accident, nothing was wrong with the guy's car but my brother's car was totaled. Then the guy said he had to go to the hospital cause he was hurt, but my brother was the one limping and hurt his head. My brother should've went to the hospital but he got a ride home and is still limping. He said it hurts really bad, but he won't go to the hospital. What should he do about people who lie in the accident? Should he go to the hospital? and what will they say and do? What will his insurance say about the guy not having any type of car insurance? and then going to the hospital? I need help ONLY from lawyers who knows or people who has been through the same thing and got out good.

The guy's car was messed up alittle on the fender but not like my brother's car his car is definitly gone totaled, never again gonna be on the street and junk yard material.

Number 1, my brother does have insurance on his car. The guy at the stop sign did not have car insurance on his car!
Number 2, don't give me an answer unless you have been through it or you are someone that can help and answer my question I want real answers from people who know, not from people who are just writing to get points or say anything.

First, have your brother go to the hospital. He needs to at least get checked out to be sure something serious is not going on. He needs to report it to his insurance company right away. In most cases, the person who comes out from a stop sign is the person at fault. You are only supposed to procede from a stop sign when it is safe to do so. Hopefully there was a police report (so the other person would get a driving without insurance ticket). If you brother had medical payments or PIP coverage, his medical bills will be paid by his policy, up to the limit. If your brother had collision coverage on his car, his car will be covered for the accident no matter what. If he didn't have collision and the other person was found to be at fault and didn't have insurance, if he had uninsured motorist property damage (& not in a state with odd UMPD laws), his policy will pay for his car under that coverage. His insurance company will go after the other person for the damages they pay (if no insurance, they will go after the other driver personally to pay for the damages). If the other person does not have insurance, if your brother has uninsured motorist bodily injury coverage, he can be compensated from there for his injuries. I hope this is helpful to you.

If your brother had proper insurance, everything won't be a disaster. First of all, if your brother is in pain, he needs to go to the hospital right away. Worry about money and insurance later! Since it sounds like your brother was at fault in this accident, his insurance will have to pay for the other guy's car repair (if any) and any injuries he may have sustained. Depending on what type of coverage your brother has, they will probably pay for his hospital bill, and to fix his car. The insurance company will do their own investigation into whether or not the guy in the other car was faking it. He will have to sigh forms at the hospital to allow the hospital to give your brother's insurance company his health information. If he isn't really hurt, they'll know. If he fools the doctor, there's really nothing you can do. Your brother's insurance payments will probably go up because of this, and in the worst case, his insurance company may cancel him, depending a lot on his driving history, but as I said, there's nothing you can really do. Were the police at the accident? If so, their report can help your brother's case. Have your brother report everything to the insurance company ASAP so they can begin investigating. A lot of people in car accidents lie, so insurance companies are prepared for this. If he does something crazy like try to sue your brother for pain and suffering, he will have to hire a good lawyer. first of all, it is illegal (at least where i live) to drive without car insurance.
how does it work out that your brother's car got totaled when the other one wasnt damaged at all?
