Ok my car was in an accident and claimed as a total loss. I was given a rental car and to wait out the check. I didn't want to be without a car when the check arrive so i was looking for deals on cars and ended up buying one before recieving the check which they said was on its way. Now its feet dragging and sign this and that. I wanted to know since i have a car now and turned the rental car in can they pay me for me using my car? since i technically should still be in my rental.

No,you technically did the right thing, mitigated your damage(s), and found a replacement vehicle. By the way, THIS you are required to do by law. They don't owe you anything else other than payment for your damages to your car.

As for the t/l process....you would think it was a piece of cake wouldn't you? You think your insurance company is dragging their feet? Ya, that's what their doing. State law has nothing to do with it, DMV regs have nothing to do with it. Phone calls, mail, the 100 other claims they have to deal with have nothing to do with it. You'll get your money when state law has been satisified--all it takes is the DMV rejecting the title work on your car and there's a HUGE delay right there.

No, you can't be paid for a rental for the time you didn't need one. And I doubt very much they said, in written form, get and keep a rental until we send you a check.

If you have two cars and wreck one, they won't even give you a rental, you will be expected to use your second car. If you buy a car, new or used, you don't need a rental any longer, same deal.

yes you might be able to get addtl loss of use from the insurance company; it wont be the same amount they paid per day to the rental company; most companies will allow say $10 to $15 per day if a person uses another car in lieu of renting; it saves the company money and the other person gets the benefit; you cant argue that you should be paid the same as the rental, since the rental company has overhead and expenses;

also; they may only allow a certain amount of days, stating that if you had signed something on the 1st, but signed it on the 5th, they may not include that time;

You cannot get paid for using your own car. You should have just kept the rental car.

Hah, no. I would've kept the rental car and let my new car sit until I didn't have the rental any more.

they paid for the rental.
they paid for the new car, or, reinbursed you.
what else did you want, i dont get it? them to pay you to use your car? how do you mean, like you are to make money like the rental car dealership?
no, no they arent going to give you more money.
you could have waited, but you choose not to.
and i cant see how you would even be out an attitional penny, maybe you can explain how they would.

No. NEVER spend money before you have it in your hand. You turned in your rental by choice.

No, they paid for your car. Quit grubbing for money that you know damn well you are not entitled to.
