My contract hire company seem to have failed to send out my tax disc (for period beginning 09/07). I've checked with the DVLA and the vehicle IS taxed, but I'm getting varying information as to my situation in the eyes of the law if I wish to drive it. Can anyone help clear this up?

I have contacted the hire comapny, who imform me that they've arranged form a duplicate disc. All I actually have from them (Bank of Scotland) is a letter stating that the vehicle IS legally taxed, but I doubt that this will do me much good if I am stopped/reported.

Section 33 of the Vehicle Excise and Registration Act 1994 provides the offences of failing to display or exhibit a vehicle licence, trade licence or nil licence.

33(1) It is an offence to use or keep on a public road a vehicle in respect of which excise duty is payable (this includes vehicle licences, and trade licences) and which is not displaying the licence in the appropriate manner.

Therefore, you, as user, are committing the offence. It matters not who actually owns the vehicle.

The law states that you need to DISPLAY a valid tax disc, even though the car is taxed you can be prosecuted for not displaying it.
Contact the hire company ASAP and as them to send a copy as soon as.
In the law you should check the car tax disc every time you get in the car.

You will be done yes. Its still your responsibility NOT to drive a car without tax. You should leave it at home until you have sorted it out. You'll get lots of points and a big fine if caught. Its very slack of the company not to send you a new tax disc. Mine usually comes the month before.

It is illegal to drive a car that is not displaying a tax disc. So it would be you committing the offence.

That said DVLC are highly unlikely to prosecute if there is tax on the vehicle. But it does bring attention to the car and could cause you to be looked at by police, traffic wardens etc and you face the inconvenience of being reported.

The onus is on you to contact the hire company and check it out.

First question is have you spoken with the hire company?

What do they say?

You are committing an offence if you fail to display a current tax disc.

You can be done for failing to display a valid tax disc

ring dvla,up confirming whether they have had this car taxed, by email/letter in writing if no send a copy to your company .

if still no help
ask to speak to the manager and cancel your car contract
