My car got hit by a garbage truck at home in my parking lot.Guilty party is offering to pay for the repairs by check w/o insurance company getting involved.Now,this just happened 24 hours ago and so far they seem to be cooperating just fine.Just in case they should try to screw me,how much time do I normally have to inform THEIR insurance company about the incident? Is it 10 days,14 days or 30 days???

Legally, the statute of limitations in most US states is 2 or 3 years. That means that while you can make claim for an accident ANY time during the statute, you also have to have it settled before the statue lapses. So don't wait until the last minute!

On the other hand, any delay in reporting could undermine the insurance's ability to conduct an adequate investigation of the accident. If your delay caused them to be unable to investigate, they are well within their right to deny your claim, since the burden of proof falls on you to prove you were damaged. They have no burden until you can prove otherwise.

I had the same situation once, it wasn't a garbage truck but a couple of guys hit my car and stopped. They were very sorry and offered to pay for the damages, well the next thing I know, they have disappeared and couldn't be found. So we had to turn the wreck in to the insurance company ourselves. Get a police report on it and file with your insurance company. You want to be a nice guy, but sometimes people will take advantage of your good nature.

I learned the hard way, I hope you don't have to.

It is 48 hours! You don't contact THEIR insurance company your insurance company does that. You need to have a police report to support your claim when you call. Basically, you are in a position to be screwed.

Get a police report and than call your insurance company they will give you the best advice. Good luck

As far as I know, you have three months to insurance co. and 24 ours to the police.
Confirm with your insurance company, they can handle the claim on your behalf.

i would get a police report then you would be safe and go to a repair shop and get a estimate then take it to the person who hit your car and see what he says. if he won't pay then you report to his insurance company
