I hope you aren't in the UK! It is a serious offence, in the UK, to not have insurance. It is also a crime that can be punishable with a prison sentence, heavy fines and a guaranteed driving ban. If a person is caught with no documents at all, the police usually drop the charge of driving without a licence as that will result in a small fine and a short term driving ban, at worst. For driving without an MOT and / failing to register the vehicle, they will drop the charges as these usually carry small fines. Therefore the police will bring only the worst offence of driving without insurance. The way the courts see it is this - if you run a child down and that child is disabled for life, you cannot pay for the 24 hour care that it requires and therefore the child has a life time of suffering. If you kill a child, you cannot compensate the family. Therefore, the courts see you as not only a potential killer but also one that cannot aid in assisting those effected. You can easily take somebodies livelihood away, in an accident. Can you pay somebody's salary for thirty or forty years? I would suggest you pay for your own damage as well as his and get some insurance as you should not have been on the road in the first place. Therefore, the accident should never have happened. By driving without the insurance, you are 100% to blame.

This is what I have been told. In the USA, if you are involved in a traffic accident and you do not have insurance, you are at fault no matter what. The accident would not have happened if your uninsured vehicle wasn't on the road.

Why were you driving to begin with? You will probably get a ticket for not having insurance. What if the person had been in your boat with no insurance? Bet you would be mad about now.

If you are in the US his insurance should take care of it for you. Why don't you have insurance? If you were in a "real" accident, this could ruin your life!

THE OTHER PERSON THAT WAS AT FAULT WILL BE RESPONSIBLE FOR THE REPAIRS.
ON THE OTHER HAND YOU WILL BE RESPONSIBLE FOR PAYING A HIGH COST FOR DRIVING WITHOUT INSURANCE.
THE ABOVE WILL BE TRUE AS LONG AS YOU FILED A POLICE REPORT AT THE TIME OF THE ACCIDENT.
