can anyone describe me the difference between judicial activism and judicial restraint? . why is this important when selecting the executive?

I keep getting e-mails saying you have the same second name as me late clinet and he/she left millions of dollors in a bank account. All you have to do is sine an affadavid and we can split the money 45 55? I know it sounds like a scam, Has anyone else got any of these, and followed them true??????

Lets say someone sue me for several millions of dollars. If I dont have the money, say I am a busboy earning 1500 a month, how am I going to pay? Where is the money going to come from anyway?

on monday,i received a voicemail stating i was being sued.i called the number back and the "lawyer" i spoke to said providian was suing me for "x" amount.then the "lawyer" changed the amount to"y" $. finally, i agreed on "z"$ to keep it out of court. i paid $100 over the phone monday during the conversation. the rest was to be paid on the 31st. after doing some research and talking to several people, i found out this whole thing is a fraud. i have already reported them to the ftc and the attorney general. i am going to talk to the bank today about getting the 100$ back,if not,at least stop them from getting the rest on the 31st.(i sent a postdated check). yes,i did have a credit card with providian,but it has been taken off my credit report.(statue of limitations) can they still sue? on what grounds? should i sue for harrassment? there has been no proof for what i owe.(bill,statements,etc.). the last time i paid was april 2001,which was the last time they sent a bill.

I was driving without a licence and hit a mailbox. I was so scared i took off to my house. It turns out someone spotted me and now i have court tomm. Im so nervous because i know i messed up but im wondering if anyone knows what i should expect from the judge. Ive heard its a felony to hit a mailbox so im really scared i do not want to go to jail so even if its bad news someone just answer

Here goes the story. I was heading to work. The road conditions were normal, it was a sunny day around 5 PM (Rush Hour).
We were headed southbound on a 3 lane highway.
Traffic was moving about 35 - 40 miles per hour.
Next thing I know the guy in front of me slams on the brakes, but his brake lights do not come on.
So I slam on my brakes but unfortunately it was to late and I slammed into the back of him.
There was 5 cars involved in the crash including me all in a straight line.
When the cops arrive, I notify them that his brake lights come on, he ignores it for the time being. So I tell some of the other drivers and a couple of them go to check the lights and they see they are not working. So again I go and tell the cops this but they completely ignore the fact.
They cite me with the ticket and even let the guy with no brake lights drive away.

Is there a way I can fight this to prove that I was not at fault??

i was told that it is legal to posses a certain amount of fresh mushrooms in florida and i was wondering if this is true and if so how much can u have? this kid got arrested the other day for possesion of a controlled substance when he was caught in a field picking these "magic" mushrooms, im not sure how much he had but they dont get much fresher than that any help here would be appreciated, also what is the penalty for possesing shrooms? is it a felony? how about trespassing? in florida. thanks

I am currently covered by a state-enhanced version of Medicare; my family is extremely low-income and this health coverage is far superior to that offered by the private graduate school I will be attending this fall. However, the school is not accepting my waiver form saying that government insurance does not meet the school's waiver qualifications (only employer insurance programs do). Can they do this to me and make me pay thousands of dollars I don't have for redundant school health insurance I don't need? Anyone knowledgeable enough to know whether this is something I can fight legally? The school and my insurance are in NJ.

is asking me to sign papers saying im responsible for any damages that have happend since the divorce... I have lived in the house since the divorce and taken care of the property and pets since the divorce happend... he wants all the equite and escrow that has occured but we have payed all bills 50/50// should i sign the papers and give him all the equite or should i be entitled to half of the equity?? the reason for the divorce was he cheated on me and i have evidence of it.... please someone give me good legal adivice...

wow you guys all have such good adivce... i do agree i need to get legal advice but i just am afraid of the cost.... Ill add one more detail to see if anyone can help me understand it more... we bought the house as a married couple.. he has paid for the reality cost but it has never sold... so now he is wanting to live in it and im suppose to find a new place in 35 days... we split everything 50/50 after the divorce.... but i have had to maintain the house/land/pets since the divoce... which does cost money.. especially after 9 months... do i just let him take over the payments and give him the equity and escrow? or do i fight him with a lawyer?? the property value has decreased alot since we bouth it.. bought for 190 asking 176 and still no takers.. please help me.. :(

one other thing, when i signed the divoce papers i agreed i would take the best offer... but is it the best offer if he is the one refinancing it to live in with his new gf?? he is telling me this is my best offer and to take it so it will be done.... please help :(

If the hours that I worked during the 4/29-5/12 pay period I had 40 hours the week of the 4/2h, but only worked 24 hours the week of the 5/6, since I did not work FT hours both weeks charter made the change to PT status effective 4/29 since the change had to occur at the beginning of a pay period. Why could they not have done it mid week or after the second week. Since I worked 40 hours the first week I think that I deserve the status for the week that I was FT I am not getting the benefits that charter promised me. Can someone help me through this to figure something out.

Yes, I have the original bill of PO fees payments, after that I talked to a friend who works as Deputy-GM in the same field of industries.

He LOVED the invention and said it's a brilliant one, He wanted it to be manufactured right away, and planing to invite me on a meeting within 3 day's with the GM.

BUT how to convince such hard-headed, old-stylish GM if he asked me: There is no prove that you own the patent yet! How can you rent or sell it to us?

Please HELP me to reply if above question will be asked, so to be ready for unexpected surprises!!

BTW: I just can't wait approx 2 years to get the final Certificate then to start working it out, I really should manufacture it ASAP.

I had moved into a room in a house with my own bathroom, living with the landlady. She had done nothing to clean/prep the room or the bathroom for my movein. The room carpet was not vacuumed. The rug in the bathroom looked like it hadn't been washed in years. The bathroom floor was peeling up where it met the walls. Everything was dirty. I didn't want to complain, so I didn't ask for anything to get fixed or cleaned. I just learned to adjust to things. She never did the initial inspection for move-in with me. She didn't offer and I forgot about it.
But ever since I gave my 30-notice to move-out, she has been giving me all kinds of problems. I overheard her to talking to someone about damages and about being the victim. (I had called the police on her this weekend for spitting on me and 3straight days of harassment).
I think that she wants to remodel the bathroom because the guys said something about 3 months. Can she really make me pay for all this? Email for details.
