That would be covered by copyright law, not patent.

And yes, you cannot duplicate any work that is protected by copyright -- or make changes and then publish it -- without the owner's permission. Simply putting the owner's name on it does not affect the protections against copying and distribution.

No, you would have to give credit to the author properly. For example you could say "adapted from _____ by ______".
