on monday,i received a voicemail stating i was being sued.i called the number back and the "lawyer" i spoke to said providian was suing me for "x" amount.then the "lawyer" changed the amount to"y" $. finally, i agreed on "z"$ to keep it out of court. i paid $100 over the phone monday during the conversation. the rest was to be paid on the 31st. after doing some research and talking to several people, i found out this whole thing is a fraud. i have already reported them to the ftc and the attorney general. i am going to talk to the bank today about getting the 100$ back,if not,at least stop them from getting the rest on the 31st.(i sent a postdated check). yes,i did have a credit card with providian,but it has been taken off my credit report.(statue of limitations) can they still sue? on what grounds? should i sue for harrassment? there has been no proof for what i owe.(bill,statements,etc.). the last time i paid was april 2001,which was the last time they sent a bill.

Your one of these people thats always looking for a wall to bang your head into.....just get your 100 back, and move on........

Trace the source of the calls so that you could back what you paid.
