Individual Rights vs. Public Order?

I need some thoughts on this. I have an essay to write and I am stuck at 1000 words. I need more. I just want your thought on the topic.

Society is a balance.

In all societies, there is some balance between freedom and control -- between what people are allowed to do by choice, and what they are compelled to do (or not do) for the good of the community.

The balance is based on the values of the community -- some communities think conformity is more important, because it leads to security -- some thing freedom is more important, and they are willing to take more risks to protect that freedom.

But the issue is the same -- what is more important, and where do we draw the balance line.

What is the greatest good? And what is the way to achieve it that is the most just?

In the Viet Nam era there was a famous saying - In order to save this village we have to destroy it. If we lose all our rights in order to preserve our rights - what have we preserved? On the other hand, if we refuse to surrender some individual rights for the common good, we may also lose our rights, as some other entity destroys what we have.

I think the two sides of the question as you have posed it are misleading - I think there are better ways to frame the other position than "Public Order." Totalitarian states throughout history have stressed Public Order as an overriding good. That is perhaps the ultimate "Slippery slope."

I seem to recall a famous quote that goes something like

Those who would give up liberty for safety deserve neither liberty nor safety.

Im missing words, but too busy to look up the exact wording.

Your rights stop when they violate another person's, not when you make a uproar. Thus you see, smoking is not a threat (assuming a respecful smoker not blowing it in your face), so it should not be restricted. Theft should be illegal though as it does harm others.

When your actions cause others harm, then public order should become the most important. We have free speech unless it leads others to committ crimes or atrocities from our speech. Also, you cannot yell, "Fire" in a movie theater.
