I was wondering if anyone might know whether or not the expert witness surgeon that looked at my medical records would bother to set up a consultation with my attorney if he didn't think there was a case? Would he not just tell him over the phone, "No negligence." ? Thanks alot

I sued someone in small claims and the court did not award me. The defendant then turned and filed a counterclaim and the court awarded them $1,500 (which I was supposed to pay). So is that considered a "judgment" against me?

writing my own divorce papers, to save $ in lawyer fees. so i can't consult one on this subject, yet (had 1 mtg, more req. retainer) . i'd like answers based on knowledge/exp. no judgemental notes, plz. thanx. in dividing assets: he gets the house, a rental we own (split proceeds for both 50/50 if sold) , his car, asking for no retirement benefits from him (i don't work, stay at home mom to 3 & student). i'm moving to an apt., asking for state reg. child support, $500 alimony, (expires in 3 yrs to help me finish school, get the kids in school, get a job). taking an auto loan off his hands. my thng: i get 2 annuity lumpsum pymnts in 5 & 7 yrs of a decent $ amt (from a childhood accident). @ consult mtg atty told me he is entitled to part. if i'm not asking for retirement (military...eligible?), houses & by that time not getting ali., do i have to legally share that $ w/ him? what if i am remarried or he is? i got the 1st setlement when i was 13, these are the last 2 pymnts.

We used to smoke inside with permission from our landloard who also smokes inside even though our apartment was listed as a non-smoking apartment. We used an exhaust fan and only smoked in one room with the door closed. Our upstairs neighbor complained her apartment was filled with smoke from us. We have been smoking outside for 3+ weeks and she has again complained that she wakes up every morning to smoke and a headache. I guess it's possible that the smoke is going through her window from outside even though I think its still too cold for her window to be open. She leaves notes on my car telling us that smoking causes cancer and yadda yadda. We have respected her wishes to not smoke indoors and now she wants us to smoke outside and AWAY from the house. We have a private back porch and that is where we smoke. I cannot help which way the wind blows. Outside is outside and we pay rent too. Does she have the right to tell/ask us not smoke outside on our own porch?

Mother passed away a she had a house that she was still making mortgage payments on.
There are 2 silbings left. Mother didn't get a chance to add our names. What do we do with the house? Can we sell it. The payments
are still being made.

My friends put peanut butter on the back of some kids jacket when on the bus. When he found out his mom called me and said she wanted money for the bookback that was ruined we gave her 30 but she wanted 40 or she told us she would tell the school is this legal?

My mom needs to kick my 24 yr old brother out and don't know how to go about doing it because she verbally tells him to leave and he tells her he dont have to so how could she get him out legally and its in grove city ohio she has tried calling the local police there but they are no help either

My friend made it through basic and AIT but then before he was transferred to his unit he went to his commanding officers and told them about his gambling problems and how he needed to get help right away.. They didnt do anything at first so his family contacted red cross and the red cross contacted the military and he got a 10 day leave before going to his unit... He never made it back to the army. He was been gone for two years and he went to GA for his gambling help and he searched for god and found help there... It has been 2 years AWOL and he has gotten pulled over by the cops once for a speeding ticket and went to court... He has a good job where they run a background check on him... Hes bought a house and a new car... All of this while he was AWOL... And now that hes gotten the help he has saved up money for his family while hes gone he wants to know what happens now with the AWOL and why they havent hunted him down or arrested him when he was pulled over or bought a house????

My daughter and others were asked to open their private MYSPACE pages as an interview employment condition. The interviewer deleted comments with words he did not deem appropriate and chastised her for some of the content of the private messages sent to her from others. Is this legal?

ok here is a situation a girlfriend and a boyfriend were about to have a baby but they did not want it and had no money for abortion so the girlfriend said to kick her in the somach till she lost the baby the boy friend got arrested for murder but here is the thing

the baby was not alive (unborn means your n not alive for the idiots) and he had permission to kick her and there was no murder or assult involved how can courts do this can they sue the state i know i would

I've had a lot of trouble at work with co-workers...I seem to get along just fine with my boss and other management people but when it comes to my co-workers (mainly women), I get a lot of animosity and generally "unkind" treatment. I just try to blow it off but it bothers me, of course...even our HR person is treating me funny. I'm almost 5 months pregnant...there are a couple of other people expecting in our department too. Today, she just informed them all about some extra insurance benefits...but she never told me! She is very well aware that I'm pregnant. I knew it wasn't coincidence b/c I was in the area and even passed her by to make sure she saw me...she just smiled and walked on. This is the woman who's supposed to help coordinate my maternity leave!? I'm worried...in case she does something wrong (whether intentionally or not) that will cost me, what are my legal rights? I'll be damned if someones personal feelings toward me causes me problems outside of work.

if someone put stolen property into someones house, but the owner of the house gave the stolen goods to the police, can the owner still be charged with recieving/pocessing stolen property?

I am writing a paper on American Racism. I want to write about some of the most unfair convictions against blacks and how they would not have been convicted or given a lighter sentence if they were white. I'd prefer the cases to come from the 1950's or so era.

One of the cases I want to use: 17 year old Jeremiah Reeves who was caught having consensual sex with a married white woman in Montgomery Alabama and sentenced to electrocution on his 21st birthday.

I was waiting in a cell at the court after I had already seen the judge and he had refused to release me on personal recognizance. My bail was set at $500. Later a security guard walks around and goes cell by cell asking people for a name and number so he could make the call for bail for you. I was never taken out f the cell so I could talk on the phone. He was the one who made the call supposedly. I think the person being held should be allowed to talk on the phone instead of some guard because what if he never made the call and pretended he did? My friend said she never received such call and as a result no one knew I was there until I was sent to the jail and was able to call from there. If they would have let me make the call or at least dialed the number in front of me and then put the phone to my ear I could have posted bail right there at the court. Was it unconstitutional or a civil rights violation? I think it was and I am going to sue.

Is it likely that you could get jail time for a first DUI with no previous. There is no mandatory jail time where I am. I think they are just saying it's a possibility to shock him - I hope so.

This is my brother whose 19 - so also underage and never been in any trouble before.

I got 30 days for a DUI but that was because of my priors and I had a record.

Would it not be very harsh for a first offence?

hi

my uncle has just died in spain. he was from the uk but moved to spain in 2003. he hasnt left a will. he has money in accounts in spain and also a uk bank account

does anyone know if we can deal with the uk bank account under uk law and then the spanish accounts under spanish law
also does anyone know how hard it will be to get the spanish stuff sorted intestate and what sort of problems we might incur.

Someone I know ordered a chinese child online. The child was supposed to go to school in the US, ect ect. Instead the person I know has turned the child into their own personal servant and only lets the kids play outside in the backyard at night and does no schooling, home or public. Basically the kid is kept away from view of the neighbors and everyone else.

I feel there is something terribly wrong with this and I am not sure if I should take the child to the police or if I should just look the other way. From what I can see there is no physical abuse, but I dont know.

I have no agenda against Mormons or Jehovah Witness.
The problem is that I have a no soliciting sign on my door and yet they still knock.
When I point at the sign, I either get of we didn't see that. It's at eye level...
Or "we aren't soliciting, were spreading the good news.." (blah, blah)
I heard of a guy doing this to keep telemarketers away and I think it worked for him. Not exactly the same situation, but here's my idea.
Put a sign on my door (below the "No Soliciting" sign) that reads in effect that violations will result in a fee of $50 for my time.
Anyone ever try this or know about it? can it actually work?

My mother passed away a little over a year ago and my step-father has simply fell off the face of the earth. He has been doing everything my mother said he would, such as selling property and not staying in touch with anyone.

They were married for over 20 years and my mother had a lot of investments. Is there any way that I can get my share of what my mother had in financial investments from my step-father? Do I have any legal right to any of her estate?
