Is it likely that you could get jail time for a first DUI with no previous. There is no mandatory jail time where I am. I think they are just saying it's a possibility to shock him - I hope so.

This is my brother whose 19 - so also underage and never been in any trouble before.

I got 30 days for a DUI but that was because of my priors and I had a record.

Would it not be very harsh for a first offence?

All DUIs carry jail time. Usually two days. However, with no priors or warrants, you'll be released in the morning, but still have to serve 48 hours, sometimes you have the option of taking the DUI class at a hotel or barracks which counts toward jail time.

It is all a matter of your past record, but 2 days minimum unless you get a deferred judgment.

Trust me, I've had too many friends go through it.

Many states are cracking down on the sentences given out for DUIs. I believe they should to show people the seriousness of driving under the influence by giving people jail time and rehabilitation.

People need to understand that prison is to help punish the act and help rehabilitate the person to help prevent future crimes and to help the individual become a productive member of society. However, many facilities are not doing so good with transitional programs and many people go back.

Your brother knew that that drinking underage is against the law and he is an adult. I think 30 days in Jail is too lenient of a sentence. In my opinion, he should receive a year in jail and his license taken away, and it shouldn't matter if it's a first time offense or 3rd time, it's still against the Law! (if it's a repeated offense, they should receive a longer sentence)

My husband is in prison and has been sentenced for 7 years for prior drug use. And he is doing his his time gracefully. He understands that he made a mistake and will work very hard on turning his life around and knows the consequences if he messes up.

Most states crack down harder on drug use than alcohol related offenses. I feel that drug addictions are a medical condition and should be treated as so. It would be a good thing to have a person spend time in a jail facility while receive medical treatment and rehabilitation.

Is it likely for a first offense, not usually, but keep in mind that he is also underage so they may think he needs a little wake up call.

Here's a wake up call -- you and your brother are both toying with other people's lives, a drunk with a car is not better than a psycho with an AK-47. Either could kill some one in the blink of an eye.

I am guessing here since I don't know what state you live in but here in TN 48 hours is mandatory.
I'd say you brother will spend a weekend in jail.

Personally, I think it should have been 10 times longer. Drunk driving is foolish and stupid. You could have killed someone and it could have been a little child.

I have no sympathy for drunks.
