Very brief explination. I own a bonding company. I posted a pre-trail only bond for a defendnat. He pled guilty and was sentenced to 9 years in prison. The judge let him go home for 30 days before reporting to the prison. Missouri law says that when he is sentenced he is to imm. be taken into custody. I appealed and the appeals court denied my appeal saying it was legal, even though Missouri law says different. I need to get this decsion reversed in federal court, perhaps through a writ of certori, but what other than judicial desretion or judical activism do I argue. My problem is my attorny is my best friend and he is in uncharted territory. My wife and I have five kids and we really cant afford to pay this $100,000 judgment just becasue a judge and his buddies think it is ok to do what they did, even though it is in clear conflict with state law and the bond was marked clearly as Pre-trial a stay of execution would be a psot-trial matter. Please Help!

Now, I'd like to ask you something: who are the thieves here? Those who sell original digital products at very high prices to earn much more that they spend to produce them, or the ones who are forced to buy pirate copies given the absurd prices of the original ones?

Hypothetical situation:

Let's say I'm going to have sex with someone. He asks me if I have AIDS. I tell him I don't. Then we then have sex. Afterwards, I reveal to him that I actually DO have AIDS, but lied about it because I really wanted to have sex with him.

Can I be charged with a crime?

The ditch runs across the rear of my lot. My lot also extends past the ditch on the backside another 15 feet. So the ditch is completely encapsulated by my property. The city maintains the ditch. I was told by one of the kids mothers that since it is a city maintained easement, that the kids arent even on my property and therefore not trespassing. She believes they have a perfect right to play there as she considers it city property. This seems crazy to me and I would think that even though it is an easement it is still part of my property and therefore I still maintain the right to deny trespass.

Could it be argued that this is unconstitutional, given the fact that "blue laws" are typically in place due to someone's religious preference and the fact that the sale of cars is a pretty secular activity?

My Bank of America credit card gives me 7 days to mail the payment back to them before it is considered late. Shouldn't that be illegal. All other bills give you more time to mail a payment.

The merchant said that the gift cert has been declined, and they'd like me to give them MY credit card number. I contacted the gift certificate company and told them the merchant had not been paid. Gift certificate company said merchant JUST sent in the voucher number and they pay on the 15th or the 30th to the merchant. So the merchant says that I should pay it until the gift certificate company pays them. Would you pay them? The gift cert was from a collegue of mine; who I have informed of the difficulty of this gift certificate. If the gift certificate company doesn't pay the merchant, should I ask her to pay for it since it was supposed to be a gift from her?

Am I at all liable to pay for this "gift"?

We are all, sadly familiar, with the stories in the media about people who pray (sometimes repeatedly) on children. So as prison / reabilitation does not work should this more drastic method be used?

should the punishment for a crime should act just as much as a deterrent? i mean criminals probably assess the risk of commiting a crime to decide whether it is worth the possibility of getting caught. for example, if you steal a car you would probably get about 1 year, and be out in 6 months. If there was a mandatory sentence of 10-15 years which you have to serve in full, would car crime go down? it may seem an extreme sentence but i think it would stop a lot of people doing it and if they did and got caught they certainly wouldn't do it again. You could say the punishment doesn't fit the crime well then good. it shouldn't be fair.

While it's great that we can enjoy the security of a government position, we still have a mission statement to adhere to and the public shouldn't be neglected. Some individuals, without the incentive of the threat of losing a job, choose to do as little as possible. This promotes resentment from the outside. Tax payers shouldn't financially back time spent unwrapping Twinkies, watching television or playing on the computer. Someone's life may be held in the balance waiting for their particular problem to be resolved and for that alone there should be some trust that it is being handled with care and efficiency. Please tell me that there IS something that can be done.

12/01/06 "AP" -- -- -A record 7 million people — or one in every 32 American adults — were behind bars, on probation or on parole by the end of last year, according to the Justice Department.

Of those, 2.2 million were in prison or jail, an increase of 2.7 percent over the previous year, according to a report released Wednesday.

More than 4.1 million people were on probation and 784,208 were on parole at the end of 2005. Prison releases are increasing, but admissions are increasing more.

As some of you may not be aware, the videogame hacking company MSX Securities develops and sells various hacks and cheats for many of the most popular online games. While the cheats and hacks are annoying, the server problems they cause have lately begun to cause significant down-time and loss of productivity, recruitment, and substantial damages. While an individual suit against a specific hacker would obviously be valid, it doesn't address the bigger problem of the company itself.

I am looking into the possibility of filing a class-action lawsuit against this company for various damages, but was wondering if a simple contract clause would really exempt them from liability:
"Liability clause: MSX Security can not be held responsible for any illegal actions performed by the end-user."
Would this really exempt them from such a suit? Or is that just bogus?

It was shown on CNN Headline news 1 Dec 06, and it is an X-Ray machine that can actually show your body in detail beneath your clothes. This link is an article that is from May 2005, from the Maryland Gazette.net by David Grand. It describes in detail the humiliation one may experience by going through the x-ray device which "will show what's under a person's clothes (including underwear), the images of which paint a revealing picture of a person's nude body" (Grand, 2005).

What are your thoughts on this, do you feel more protected? I feel so very violated personally...i am curious who else feels this way or otherwise.

I received damaged property due to a service person coming into my home to repair a related problem. The damages caused will by upwards of $4,500.00.
What is the process of filing a case? Do I need a lawyer..or can I defend my own case in small claims court?
I gave the company adequate opportunity to solve the issue, but they have been very sketchy, and I've also reported them to the Better Business Bureau.
