The final question is if this is one of those things you fight or let go.
And I have already done the "it's the principle that matters".
Ok... an excavating company did what's called a "cut" in the street. They were contracted by the water company who was ultimately given the right of way by the city to perform.
They usually are to put large metal plates over the cut. As well as a warning barricade.
But it was only done on one side of the street. I hit a washout in the cut directly with my front wheel.
Why, it wasn't covered, I don't know. It just wasn't done.
So I am out about $300 repair damage to the front end (wheel ball joint) of my car.
I realize that's minimal since it could of been so much more damage.
It's not like a nail was in the road and it's "no fault".
It could of been prevented were it not due to someones negligence of not following proper procedures.
The question before the one above is, who would be ultimately responsible for the damage?

They let her off with a slap on the wrist, which was VERY generous. I was just curious as to whether they will alert other grocery stores in our area, or something of the sort. I trust and pray that this will never happen again, but I feel it would be awful if she was ever treated suspiciously for a very bad mistake. Does anybody know?

Last week a co-worker of mine was killed in a car accident. Our employer was promptly notified. However they didn't tell any of us that the accident even happened. So we didn't know that our friend had died until we started hearing a bunch of rumors. They said it would have violated the HIPPA law so they couldn't tell us ..I don't think it would have just wondering if anyone knows? I think this was very inconciderate of our employer>

Britain plans to ban the sale of samurai swords because the weapons have been used in a number of serious, high-profile attacks. The Home Office (Britain's Interior Ministry) said on Wednesday the swords would be added to its Offensive Weapons Order from April next year, meaning they could not be imported, sold or hired. However collectors of genuine Japanese swords and those used by martial arts enthusiasts would be exempt from the ban.

Lets see, ban guns, nope violence still happening, in fact went up. Now swords. The stupid just never seems to end.

I was going home on the late train two nights ago, when I saw some bloke obviously trying to pickpocket a woman standing in the middle of the train.
I was about to shout 'hey' when he was spotted by a large builder-looking fella standing not far away.
He grabbed the pickpocket, who was a skinny runt of a guy - about 30, bit unkempt - and starting beating the living sh1t out of him. Then, what I suspect was his mate, joined in. They kicked the cr4p out of this guy.

The woman poked him with her umbrella, sort of joining in.

Anyway, next stop, they door opens at Queenstown Road and they literally throw this guy onto the platform where he lies in a heap.
Thing is - I'm now thinking, on reflection, shouldn't I have done something? OK - he was a thief, but they nearly(?) killed this guy. Shouldn't I have intervened, or called an ambulance or something.
I know it's stupid, but it's really bugging me.
What would you have done? Did I do the wrong thing to sit on my bum and just look?

My sister was seeing a doctor for her baby blues and moodswings after the birth of my nephew. About two weeks before she ran out of medication she called the doctor to get a refil. She left numerous messages with the receptionist and on the answering service but he never returned her call. She also called in the refils to the pharmacy and they were not able to get ahold of the doctor either. Eventually she ran out of her medications and went on a downward spiral. She ended up having to be hospitalized for her condition. Does she have a legal standpoint to sue the doctor?

I have had a couple people yelling at me for having a picture they claim to own, hosted on my website. They demand I take it down, but cant do anything to prove they own the picture, or that they have a copyright on it. The only thing they can prove at all, is that they had it on their website for 3 months longer then I have.

Is their claim valid if they have no proof or paperwork on the copyright? And since their website has the picture up for all the public to see, save, or take as they please, am I really in fault for putting it up on my website under the same conditions they have?

The image is not all that important to me, I just hate the idea of packing down from a loudmouth that cant back their claim. If I do that every time, I wouldnt be able to have so much as a smiley face icon on my website.

Hello,
I was curious, My fiancee is in a middle of a lawsuit with McDonalds for a case in which earlier this year she was struck in the head by a metal pole that wasnt position correctly on a outdoor table and had debris and was not secure. She suffered a mild concussion, and missed about a week of work for time off and doctor appointments. The Attorney at first asked for $7500 but McDonalds would like to settle with $5200 which would cover hospital bills and then the lawyers cost which is 30% of the outcome. I Felt my fiancee is going to be in the end screwed over and need to get everyones opinion. Thank in Advance

I've been getting calls from a bill collector for several months now. I keep telling them I don't owe any money, and to send me a statement. Everytime they have called, they have claimed to have sent a statement.

Today the same woman called, asked for ME, and once again told me I had bills from 2006, and wanted to know how I was going to pay today. I kept telling her I had talked with the hospital and I owed nothing. At that point she told me she was collecting on someone else who lived at my address.

However, I have lived here, alone, for the past five years. She said our names were 'linked' in the computer, and that's why she was asking me for the money. When I got off the phone with her she said she would get it sorted out, and get back to me.

Doesn't this violate the HIPPA laws? Why did she ask for me, and expect me to pay a bill not in my name? Isn't that illigal? I got the name of the company and the collecrot's name. What do I do now?

Sam sent me and email asking if what they were saying on a message board was true about waht this guy did to John. I sent Sam back an email saying, "Yes, I know for a fact that he screwed John over". I did not say Joe's name I said "he". I also stated that "I would under no circumstances buy anything from this guy (I did say this guy)but it was Sam's choice to do so if he choose to.
Anyway, Sam forwarded this email to Joe. Joe now has sent me a summons to sue for libel, Slander (even though it was not oral) and deframation. Joe lives in another state than I do.
He also stated in the summons that I said things about him which I did not. I didn't even mention his name in the email. The summons if full of lies. What do they mean by response needed in 20 days to the summons and what should I include in the response? Sorry for all the questions but I was served today and I need to know what to do ASAP Thanks for any help.

After the usual Spiel about "lessons will be learned" and "lines will be drawn under" and "World Class" schools and such-like!
We come the Nitty Gritty:
all this will be spread ove the next 10 years.

Here is a real "beaut": Labour sold all the Playing Fields to Property Developers.
These are the same people who give secret donations to Labour (like that feller Abrahams)
NOW, Labour is going to BUY THEM BACK!
At huge expense for Taxpayers BUT huge profits for the Property Developers.
This gets even better!
1. The reason Playing Fields were sold off ( apart from back-handers from profiteers) was Health and Safety.
2. NOW, 1000's of jobs will be created for Health an Safety Administrators and their minions to STOP kiddies playing on these newly-created Playing Fields!
3.A whole army of Lawyers will be employed to siphon Billions out of the cases of whether an "unsafe" Playing Field becomes "safe" once it is bought back from a Property Developer and expanded ?

In 2002 we rented a house to some bad people. They trashed the house and to make a long story short we attempted to take them to small claims court but they disappeared and had to close the case because we could not find them to be served. It is almost 6 years later and we know where they are at but I think too much time has passed. Can I still pursue this or am I just SOL??

I got my first traffic ticket today for turning right on red. I never saw the sign but I know that excuse doesn't matter. I am going to go to court because the traffic ticket price is about three weeks of groceries for me and I just can't afford it.

So, my question is what am I supposed to say when I go to court? I was going to plead guilty but ask for a lighter fine. If the cop doesn't show up do I still plead guilty or will they not even question me and throw it out? I don't know how it works. If anyone does please let me know.
