I was curious, My fiancee is in a middle of a lawsuit with McDonalds for a case in which earlier this year she was struck in the head by a metal pole that wasnt position correctly on a outdoor table and had debris and was not secure. She suffered a mild concussion, and missed about a week of work for time off and doctor appointments. The Attorney at first asked for $7500 but McDonalds would like to settle with $5200 which would cover hospital bills and then the lawyers cost which is 30% of the outcome. I Felt my fiancee is going to be in the end screwed over and need to get everyones opinion. Thank in Advance

This is a decision you and your attorney must decide on.
One poster said they will nor fight you over 2300.00 well that's not true, if and when they settle a case this sets the standards and conditions for other case settlements.
Also, they have attorneys on their payroll and it cost them very little to continue a court case, even it it drags out for years in the court system.

This is McDonalds; they aren't going to court for 2300. Ask for the whole 7500; it's not unreasonable.

The atty fees for them to pursue the case which they already know they can't win will be more than that.

File a case in court in order to determine the correct amount of the case.

Don't settle. And her attorney should push that issue as well. No settlement agreement unless it's more of course.
