we were told that the tennant would be out when we closed now after closing he wont move until after the first of the year so we put and eviction notice for 10days and we recived a letter from his lawyer saying he wasnt properly notified and that after dec31 we can evict. now our first payment is due dec26 we dont want anything but for him to move but our payment is nearly double his month to month verbal rent agreement please help in arkansas

im going to go take my drivers permit test....and i was wondering what they make u look in the mechine to check your eyes....b/c i bearly can see with my right eye (burrly but i can see color and stuff....)...but my left eye i can see perfectly

The non costodian father served me with parenting plan papers. He filed the papers 10/29/07, and served me 11/28/07, and on top of that our court date is set for 12/12/07. I have no time to file a response or get legal help or even do basic research that a person would do in this case.

The papers served to me have a paper inserted in it stating there is a non contested court date on 12/12/07. None of the paperwork is filled out correctly. My name is grossly mispelled, and birth date is wrong. My daughters age is wrong, and her grade level is not correct. Basically they have one legal stamp that is on a blank piece of paper, and all the forms are really fishy. He is asking for alot for not ever seeing is daughter in more then 7 years also. The court date is whited out, and new one is written over the old one. The real date says somethign different.

My questions is
Can I contest a non contested scheduled court date on the basis that I was not served on time.

(Just curious) I know if the police searched someone's home without a warrant and found evidence, they wouldn't be allowed to use it in court. But let's say somebody broke into their house illegally, stole the evidence, then gave it to the police. Would they be able to use it?

(Purely hypothetical) Let's say you had a bay window that your neighbors or people in the street could easily see in to, and you were naked in front of it in plain view (or having sex). Could you possibly get indecent exposure?

A friend of mine was suspended from school for wearing a t-shirt that says JESUS FREAK and my question is what do you think about his suspension? Do you think he should have the right to wear whatever he wants or follow dress code? With what constitutional right, you would fight this case in court?

I hired a lawyer to defend me in a case. He did his job and now I still owe him 400.00 dollars. He sent an invoice that reads the following way:
failure to stay current will resultin the filing of of a lawsuit after 60 days. This process will accrue additional fees and cost.
I am not working at this moment. I do not have a bank account or of any sort of property in my name.... I just have debts........ how much more can he charge me? What can I do? any suggestions??????

can colleges force you to have insurance through them if you dont have it yourself if you go full time? i was told i cannot waive it by a student advisor. i cannot afford health insurance.

ok well my father died 7 months ago and he has about 20 houses from 40 houses that he had so when he died my sister from my father side being a lawer obviously lied to him before and made him sign papers where it says everything for her and her brothers and sister from the same mom and dad as her but for me and my other brother which we have diffrent mothers we have nothing so my dad signed papers and it says im adquatley provided for and thats so not true so me and my brother think its a lie and everyone knows it everybody can say that will was fake and she made it and my dad cant read nor write well.my dad is 76 years old and all his kids are adults like 40 and up im the youngest of all im 17.and im so upset because she has alot of money and the best lawyers most likley and i go to some lawyers say i can contest the will and im already going to court with brother but they dont see, to be doing much and my mom dont trust lawyers cause they will work for my sister since she has money..personally i dont care about my dads money but i dont want her to get away with everything...what am i suppose to do im not rich i cant get the best lawyers and i have no idea what to do help please...i live in the U.S IN RHODE ISLAND.....

Hi, I am doing a Mock Trial case. I am the defense's pretrial lawyer, and I have to get certain evidence thrown out. The one I am stumped on in particular is on a (fake) test called Memory Mapping. It supposedly maps the brain activity of a suspect when shown things only the murderer would know.

Would most be appreciated if I could see what pretrial statements look like before I write this...

Is a subpoena legal is someone just gives it to you the day before court. I friend did this to me today because they need a witness and I was unsure if I would be able to go or not so they got their attorney to subpoena me then they gave it to me today at work.

Is this legal! do I have to go ... I told her I was not sure if I could go and why did you do this she tells me I wasn't sure if you would go or not. Can I sue in small claims court for my time I missed at work and etc ....

I almost used a lawyer that gave me completely wrong info and if I listend to him, I would have had been in deep trouble. Is there a way to make sure frauds like this guy don't practice laws that they don't have a clue about?

Given the public's reaction to the Duke lacrosse case, Michael Vick (even though he admitted his guilt later), and now with O.J. Simpson, have we, as a nation, forgotten that all alleged criminals are to be considered innocent until proven guilty in a court of law?

In all of these cases, the accused are (or were) immediately labelled as guilty before setting foot in a courtroom.

Especially in the case of the Duke lacrosse players, the public outcry to see the young men jailed for a crime, that it turned out they never committed, was overwhelming. Those three young men were kicked out of school and presumed guilty because of an unsubstantiated story about how they raped a stripper. Granted, in this case the truth was found out and they were released, but not before their lives were ruined by Mike Nifong and Rev. Al Sharpton.

So have we forgotten "Innocent until proven guilty" in today's society and instead gone to a "guilty until proven innocent" mind-frame?

back in august I used my debit card to dial a phone sex number(stupid on my part and i'm not proud of it) and a day or 2 later I couldn't find my card so i reported it lost/stolen like anyone with half a brain.in the middle of october the company that ran the hot line called me and said that someone had used my phone with a stolen card.anyway,when i called them back they seemed to know it was me and that it was my card.basically they said if i didn't pay them the left over amount that i didn't have in my debit card,they'd charge me with credit card fraud and identity theft,which doesn't make any sense to me since it was ME using MY card.oh,and the person i talked to wanted me to send the money via western union,which seemed odd to me.they never sent me a bill or anything so i don't even know if the amount they're asking for is legit.i've never been in trouble with the law at all so hopefully they go easy on me

is it justified when u do it to feed ur starving family?? even if u shoot the clerk or anyone in the process? like lets say u rob 7-11, steal lots of chips and food and money and the clerk pulls out his shotgun, then u shoot him? is it legally/morally justified when u do it for survival and food?

My landlady is trying to evict me because she believes I have "mental problems". I suffer from depression and take medication, but I don't have "mental problems". I feel like it's ridiculous to even have to point this out, because I've obviously never been a danger to myself or others. I have definite verbal evidence that she said this. Also, we're made to live in uninhabitable conditions in the summer months (up to 100 degrees inside), because we aren't allowed to have AC units. Another reason they want me out is because I "illegally" installed one.

So between discrimmination based on perceived psychological conditions, violation of the Warranty of Habitibility and health codes, and emotional distress, how much do you think I can ask for in a federal lawsuit? How much have people won in similar cases? No "it depends" statements PLEASE! Thanks.
