I belonged to a trusteeship to pay a hospital bill. I made the payments up to a balance of 200.00. the hospitals attorney are taking me to court for an additional 700.00. Is this legal?

4. Two adults, John and Jackie, were eating lunch together when John says; “I really need to sell my Harley Davidson motorcycle for $6,000 so I can pay my bills.” Jackie says, “I love mopeds, I will pay you $6,000 for your scooter.” John replies, “Great, I will deliver it on Monday.” Jackie is very upset when she sees the motorcycle on Monday.

a. Was a valid contract formed after Jackie’s response that she would give $6,000 for the scooter i.e. before John’s final response? Why or why not?

b. Was a valid contract formed by the end of the conversation i.e. after John’s final response? If so, is it a unilateral or bilateral contract?

c. Identify and explain any possible ways Jackie could get out of the contract if a valid contract has been formed. In your opinion, would Jackie be successful in rescinding the contract i.e. is it likely a court would declare it void? Why or why not?

d. Is this situation covered by the UCC or common law? Explain.

2. Figure damages for the car loan refinance contract I handed out in class given the following circumstances. Assume that the borrower defaulted on the loan and did not make any payments after the first six months of the loan. The car was repossessed by the Bank and sold for $8,000. The principle amount due on the loan at the time of default was $10,000 and the interest due including penalties totaled $2,000. The Bank spent $1,000 on legal fees and $500 in court costs. In addition, it was foreseeable by the parties that the Bank would have to make some basic repairs to the car and would have to have the car professionally cleaned prior to the sale, which cost $1,000.

I moved into a house with my boyfriend and 2 roommates in May. We live in a 2 family house and there are a group of young guys living in the other apartment. We have to tell them to lower their music at least 5 times a week.At first they would lower it when we knocked on their door. Then the next day it would be up again.

It is getting worse and worse. Now they refuse to answer their doors and will sometimes lower it if we bang on the walls. A lot of the time they will bang back and just put it on louder.

We have contacted the landlord numerous times and he claims to have talked to them, but there has been no change.

We have threatened to call the cops on them. We are pretty sure they are here illegally. The music is never in english and only one of the group speaks english. We are afraid that if we call the cops they will retaliate or somehow try to get us back and we are afraid.What can we do? What can the police do? There is nothing in our lease about loud music.

ok, i was in class,my B-It-ch A-Z-Z teacher (im not the only one that thinks) took away my ipod.... her class is soo damn boring. but anyways i was playing with my ipod, then she said to give it here. so i gave her my ipod.. then after class i was ganna ask her to give back my ipod, but she was like all the way to the other side of the building. So i watched her if shes going to the office. she didnt! i think she went straight to her car! Does teachers have the right to keep other people's belongings? She didnt give me discipline. I think they should give me dentitions. but still do they have the RIGHT to keep my ipod? What if she doesnt give it back? Could we sue her? Is she allowed to keep it? PLEASE help me

I have had a phone call from the wife of an ex-colleague, who is desperate and suicidal due to a catch 22 situation.
Her husband has had several strokes and is paralysed. He also suffers from progressive dementia. She has a condition akin to Parkinson's making her very shaky and unsteady on her feet, but has to nurse him in a second floor flat in which both are effectively prisonners. He kept sole control of his money and never shared an account with her. She is now paying for most things from the meagre earnings she made as an interpreter and is now running out of funds. Social services come twice a day to get him out/ into bed, but she has to manage everything else alone, from spoon-feeding him to cleaning continually due to his incontinence, and she can no longer lift him. He has a son from a previous marriage who lives in the USA but assumes no responsibility because he disapproved of the marriage. Otherwise they have no family, and their friends have melted away.

wow, everyone having healthcare and not having to talk to an insurance company before seing a doctor is a bad thing? Are republicans really THAT blind that they can't see Bull s#@% when they see it? Romney says he doesn't trust the government to deliver his mail... but he does, everything he sends from his office is sent by the US Postal service. Republicans are so incompetent that they tell you the government can't be trusted, then they mess up and say "see, the government sucks"

I had to call 911 for the first time in my life the other day. It was for something that happend on the highway (not with me). When I called I guess I automatically assumed that the man said "911 whats your emergency" so I started to say what was going on...... he interupted me and said Ma'am do you need the Police, fire truck, or do you have an emergency? I told him the police but it was an emergency too (this little chat lasted close to a minute), then he said "hold on I will transfer you" so after about 10 second I was transfered to the police dept.

My question is, is this normal procedures when you call? It really seemed like they wasted a lot of time.

I took one of those rediculous payday loans out and thought I had finished repaying. Anyway, I found out 2 weeks ago that I still owed them 2 payments (which should have only been about $300 but because of interest and late fees it double to $600)!!! They never sent me anything by mail nor called me prior to receiving a garnishment notice in the mail so I really didn't know I owed them anything. I called them after getting all my receipts together and attempted to make payment arrangements. They advised me that since the garnishment was in process I could either pay the balance in full to avoid the garnishment or just let the garnishment run it's course. Well, I don't have $600 right now so I decided on the latter. The first garnishment is due to come out of my check on Friday. Today, Wednesday, I noticed that they took a one month payment out of my checking account!!! Which overdrafted my acct. My question is, can they garnish my wages & deduct payments from my checking acct too?

It happened last week and disrupted whole vacation plan, I am still horrified.The hotel told me, it happened a lot in many hotel, they only waiver those one night fee and pay for medical bill. Can I sue the hotel and ask some compensation?

I am 17 and I recently got pulled over becuase "my speed was not reasonable and prudent", i went around back of a plaza going a reasonable speed (no posted speed limit) and there was a new york trooper sitting facing toward the opposite way (radaring i suppose since he was facing a major highway) and i slowed down even even though i wasn't going that fast and i drove past him and he pulled me over and i got a ticket and what not. The ticket i got did not say i was going over a certain speed or anything, it just said "my speed was not reasonable and prudent". I'am pleading not guilty, should i fight the ticket out in court?

In a recent case a Hooters resturant manager asked 15 potential applicants to go try on hooters outfits. He sent them to a trailer where they undressed and put on the outfits. It was later discovered that the changing was being video taped by the manager and police seized 150 digital photos. Hooters denies any role and claims that the manager acted on his own. Can the women succeed in a lawsuit against the Hooters company? If So what can they claim?

my dad is a welder and got injured on the job. he had a 2000lbs + beam fall on him which crushed him between two beams. fortunately another employee spotted him or else he would have died because he was unconcious the whole time. the company refused to call emergency or ambulance and insisted in throwing him in a pickup truck to take him to thier own personal clinic. when they got there, the clinic refused him because he was basically almost dead and said he had to go to emergency. then they had to drive him all the way back across town to kaiser. when they got to kaiser, kaiser was upset because they didnt use proper precedures which was to have an emergency ambulance go pick him up because would of he died along the way because he wasn't treated on time. he suffered broken ribs which puntured his lungs. fortunately he's alive and recovering right now. what options do i have to make sure i take this company down for what they've done? what type of lawyer should i contact?

When I'm at work, I search for videos on video.google.com. Whenever I find a video that's hosted on the Google servers, Google provides an option to download it in an iPod compatible format.

It seems to me that this practice would either be illegal or at least immoral being that I would be downloading somebody else's intellectual property for free. But if it is illegal or at least immoral, then why would Google allow it?

I'm proud to say that I've purchased everything in my iTunes library, I've purchased all the (expensive) software on my computer and I'm very much against piracy, but I don't get this Google download option. Is this illegal, is there a technicality or a loophole I don't know about or is this actually considered fully legal and ethical?
