my dad is a welder and got injured on the job. he had a 2000lbs + beam fall on him which crushed him between two beams. fortunately another employee spotted him or else he would have died because he was unconcious the whole time. the company refused to call emergency or ambulance and insisted in throwing him in a pickup truck to take him to thier own personal clinic. when they got there, the clinic refused him because he was basically almost dead and said he had to go to emergency. then they had to drive him all the way back across town to kaiser. when they got to kaiser, kaiser was upset because they didnt use proper precedures which was to have an emergency ambulance go pick him up because would of he died along the way because he wasn't treated on time. he suffered broken ribs which puntured his lungs. fortunately he's alive and recovering right now. what options do i have to make sure i take this company down for what they've done? what type of lawyer should i contact?

What options do you have? None unless he dies. You do not have any standing as you were not the one injured.

Your father should discuss the case with a lawyer. His employer may have violated safety regulations and laws.

I would say, you can't do anything, your dad has to contact a lawyer. The only way you can sue them, if your dad would die from the injury's (lets hope that is not going to happen). As for what lawyer to pick, check the yellow pages and ask around. Perhaps a neighbor or a friend knows of someone that is good. They should be specializing in Workers Comp Claims. Also, I have been told, never to use a lawyer from the same area. For some reason you're better off getting one from a different county. Usually there is no fee unless you get a settlement. Then they will take a certain percentage from that

Sue the hell out of them for not calling an ambulance. Other than that Workman's comp covers everything and you can't actually sue the company for the injury/injuries.

Trust me, I am fighting with Workman's comp right now. I fell from over 55' high. I broke my left leg, my back, 5 ribs and screwed up the nerves in my right arm/hand.

That was on March 24th of this year. I did receive Workman's comp payments for several months and have been back at work for almost a month now, but on 6 months worth of light duty from one doctor and 9 months from the other doctor I see. Workman's comp is telling me that I am entitled to $0 in compensation above what they have already paid. Which of course pisses me off!

Anyway, good luck to you and I hope that your father recovers completely.

I am a little surprized the lawyers didn't contact you, if it all happened the way you said it did.

Do not focus on "taking down the company". A lot of good people like your dad could loose their jobs. Focus on getting his medical and rehab needs met. The managers and foremen on the job at the time should be fired, and if the suit costs the company enough, they probably will be.

well it happened when he was at work,.....i don't know if you can (using your words) "take the company down",.....he might only have the option to deal with the state for a work mans comp claim,.....
