If I catch a person trying to steal my car, or sitting in the driver seat trying to pry the stereo out, am I legally allowed to attack him with lethal force? I know we cannot as civilian citizens legally apprehend a person, since that is considered kidnapping, but I also know that if I am simply obligated to dial 911 and threaten him with a phone call, he'll just run and escape after vandalizing my property. What is the law in your state?

The question may seem trival at first glance....however, allow me to give background info. I had 2children young. My oldest and I; were both left with the emotional scars of serious psychological, physical, and emotional abuse. He had numerous problems with drugs which also goes hand and hand with the law. We later divorced; he has never paid child support or sent cards @ birthdays or Christmas!Last time he saw them was over 8 y. ago.I have remarried,happily for 6 years for 5 of those my husband adopted my children and has treated them as his OWN!!! My ex-husband has been in and out of prison for one thing or another. This year he was released. He has since, followed us in public places,...etc. Furthermore, when he had a new child he published MY MINOR children's names as siblings!! To him this is a game!!! In the mean time My Children can't sleep.....The oldest has been dx. with P.T.S.D..Seeing him again! What rights do we have? Where does this end??? Should we have to move?

When scrutinizing First Amendment speech rights in public places, does the Sup. Ct. ever use the "compatible use" test anymore ("whether the proposed speech is compatible or not with its other principal uses")?
Or does modern U.S. law use only the more recent classifications of traditional, limited, designated and non-public forums in determining the constitutional legality of time, place and manner restrictions?

I don't get it you can have an abortion but if you kill a pregnant lady you can be charged for killing that baby? Has a murderer of a pregnant women ever argued against his charges? If so what happened.I don't want this turning into an abortion debate just wondering why our laws are sending us mixed signals.

I am remarried and it's been over three years since we split up. We had a written contract that he had drawn up and signed by a judge, but he only paid me for a month then never paid again. I have never pressured him because I used to work and make decent money but now I have another baby and have decided to stay home. I mentioned it to him on the phone and he asked me if my husband could get a second job! lol I used to feel sorry for him but I am disgusted that he expects my husband is supposed to support his son.

I was arrested and withheld my rights by talking to detectives about incident which I was totally clueless about. Sent to jail for 15 hours, stripsearched and charged with 10 counts of posession of a forged instument 2nd. Was told they had "probable cause" because my picture (drivers liscence pic from 8 years ago) in a photopack was identified by random clerk who is under investigation himself for giving prescriptions, which is what I am being charged with. I explained to detectives when asked if I was out of the country over the last year and a half and I said Yes. I told them of a trip where I was out of the country. One of the FAKE prescriptions that were written out and picked up was on one of the dates I was out of the country. It could have easilly been viewed from computers that were available and from my passport that was available also. When I got out of jail and saw my charges (10 counts) The date I told detectives of where I was out of the country I was not charged with?!

My 9 year old boy went to school last week with his shirt untucked. During the middle of class the teacher noticed and told him... " go tuck in your shirt... oops I mean your dress." then was laughed at by half of his classmates. My son feels as if the teacher was making a gay joke at him and is higly upset. Would this be considered harassment and what do I do to address the problem?

On Monday of this week my entire checking account was frozen and every penny taken out due to a garnishment order. I have never recieved word from anyone at the bank even though they claim they sent the papers to me. I did get a notice from the St. Louis, Missouri sherrif that my checking account was to be garnished, but the paper was mailed two days after the money was taken from my account. The thing is I live in Kansas City, Missouri. The court date for them to recieve their money is in January and the court is in St. Louis. Shouldn't it be in Kansas City near me so I can attend?

We live in the top floor of a condo. Both neighboors below us smoke outside both in front and on their deck. In the summer, it is a major drag when we have our windows open. The smoke flows right into our home. Is there any laws protecting us from this? It doesn't seem right that their smoke is coming into our home.

I know there are many laws requiring smokers to be a certain distance from entryways.
