If it is considered a convicted felon can you get your rights back as far as right to bear arms? If yes, how would you go about doing that. If it isn't what rights do you still have?

Yes its a felony and no you cannot own a gun.

I was also charged with a felony theft about 12 years ago in the state of NY. I have never been asked or told to register as a felon anywhere. I did serve 5 years of probation. Am I allowed to vote? Am I allowed to serve on a Jury. I went to the City to request a back ground check and it came up blank. So I went to the county and that came up blank as well. I want to start looking for a new job and I do not want to lie on an application. Am I a convicted felon?

yes. it doesn't matter wether you are convicted or plead quilty, you are a felon. You still have all your rights up to a point. A convicted felon cannot legally bear arms, but you can own one. Your rights to complete freedom are reliant on the statutes of the state in which you were convicted. As far as the federal and state governments are concerned you are a felon. Search the net for the laws in your state. You can apply for a pardon from the governor and if you receive it, all rights will be restored. For the most part, you can do pretty much as your please, but if charged with something else, your past could be held against you. Apply for the pardon

If you were found guilty and put on probation by a judge, you are a convicted felon. Gun laws differ between the states but Federal laws mean that you can't hold a licence. Federal laws require gun dealers to perform a background check so you could not obtain a gun.

Unfortunately, you no longer have the right to bear arms as defined by the US constitution. If you are found in possession of a gun, you will have committed an offence punishable by a five year sentence in a Federal prison.

Actually, you might not be a "convicted felon". Traditionally speaking you must serve more than a year IN JAIL to be a felon. Speak with an attorney and find out just what the laws in your state say about it.

if you are convected of a felony. You are a convicted felony.
As far as going through the process of the getting you rights back. You would have to contact the court or state that you were convected of that felony in that. Good luck in the process!

The charge is not always the same as the conviction. You need to check your court papers and agreements. This will tell you if it was placed as a felony conviction or was reduced to a misdemeanor. Here's hoping they reduced it...

I am trying to find out the same thing. I think if you have any felony you cannot get a license to carry a gun. I hope that's not true.
