We live in the top floor of a condo. Both neighboors below us smoke outside both in front and on their deck. In the summer, it is a major drag when we have our windows open. The smoke flows right into our home. Is there any laws protecting us from this? It doesn't seem right that their smoke is coming into our home.
I know there are many laws requiring smokers to be a certain distance from entryways.

We live in Seattle area...noone has air conditioning here. And regardless there's nothing like opening your windows and having a nice summer breeze coming through...untill its ruined by smoke. Between the two of them, there's always someone smoking.
Maybe the only answer is to move, but it seems a shame, that you can't live in a condo and expect to have a fresh air. I mean it is bad enough not having a yard.

It if is an unreasonable interference with your enjoyment, you have a civil nuisance action. Get an attorney right away. Has nothing to do with criminal laws or ordinances. I am talking about a civil injunction and a suit for nuisance.
Unless you have a homeowners' association. You may be eligible to bring an action before the board with your local or state government as an appellate court. That way you don't need an attorney but you have to present your case. It would help if you could take a sample of air outside when they're smoking so you have some hard evidence.
Good luck, I hate crappy cigarette and cigar smoke too. I don't mind pipe smoke though.

No law says you can't smoke in your home or on your balcony. The best thing I can suggest is to go down there and politely talk to your neighbors about the problem. They might actual want to help out here. Or you could just take matters in your own hands and get up off your duff and shut the window.

have you tried talking to them about it? Smokers are people too, you can have conversations. Approach it very carefully, without attacking. Perhaps:
I am not sure if you are aware of this, but when you are on your deck the smoke drifts up to my deck. I wondered if there was something we could work out? What do you suggest?
The point is, neither of you is on your decks 24 hours a day. You can learn to share a space and still be happy.

you need to lighten up! people like you are what is wrong with america. I hate cigarette smoke too. If someone smokes, I can smell it on their clothes when they walk past me. But i'm sorry someone smoking outside 20 feet away? I'm not buying it! put a fan in your window if it bothers you. get some air freshener. Stop telling people what they can an cannot do int THEIR homes. they have right too. Deal with it.

There's is no law prohibiting smokers to smoked on their home..the law applies only on the public places., public utility vehicle..and in the private places (Mall, Company,Airlines)they assigned a place for the smokers...I am not a smoker but as what i learned second hand smoker if always exposed can have a lung cancer...so you better talked to your neighboors before it's to late...remember "PREVENTION IS BETTER THAN CURE"..

They are on their deck, minding their own business. Close your fukking windows! Its bad enough that people can't smoke in public places in some towns but now people like you are trying to make a law that you can't smoke at home??

there is a reason no one in Seattle has air conditioning, its doesn't really get that hot. So close your window and get a fan if you want a breeze.

I'm so glad someone else feels this way! I used to have next door neighbors who did the same thing. It is so frustrating because they say they have the "right" to smoke, but what about our right to breathe fresh air? I know exactly how you feel. Anyway, yes, there are laws about how close to the door they can smoke, but it varies between states. You'll have to check for yours. If I were you I would pursue it as far as you can afford to. Maybe if enough people stand up, we can get something done about it. Good Luck!
