I own the property with my mom, who is now elderly. Due to a drugged and greedy brother, she's requested EXECUTOR OF ESTATE AND SOLE BENNEFACATOR. Brother, who has wiped out all of her life savings, is trying to undermind.

It is the law of "adverse possession" and varies by jurisdiction. Typically, after a number of years of residence WITHOUT PERMISSION of the owner/titleholder the squatter gains certain rights.

But consider this hypothesis: you are squatting in a leasehold property, and the rent (or ground rent and service charges, etc.) are being paid. You cannot gain rights as against the landlord but you might gain rights as against a negligent leaseholder.

In the UK these rights typically arise because of negligent councils who lose track of the occasional property, and someone manages to remain in one for ten years undetected. At that point, the occupier goes to court and gets a ruling on his or her rights. It usually makes the newspapers; and of course that puts political pressure on councils to check their properties.

For the USA, you can Google <"adverse possession" + [name of your state]> and probably find the applicable rules.

And for what it's worth: possession is never "nine-tenths" of the law (what would that mean?) -- it's nine POINTS.

If you dont own the mineral rights you dont own squat. That is why and how the Squatters Rights came into being. You can pay all the tax you want onthe Property, but if you have not filed a claim for the Mining/Mineral Rights, you dont own squat.
Tell you a fact not many know, anybodies house can be taken away and dozed by the one that owns the Mineral Rights under thier property.

Andy is right. Adverse possession means you live in or make use of the property without the owner's permission. In California the period is 10 years of uninterrupted possession without owner's permission. It is more in other states

If you already own an interest in the propertry you cannot be a "squatter."
