I bought my son a Sagem my401x mobile phone in June this year. Within a few weeks it started to go wrong, sound was bad, buttons not working, photo quality deteriorated. We took it back to the shop asking for a replacement but were told as it was more than 30 days old it would have to be sent for repair. After waiting about a month for the shop to have a phone in stock to borrow during the repair, it was sent away. My son collected it yesterday, apparently all the inside has been replaced. Low and behold by last night it was going wrong again, buttons not working and it keeps 'freezing'. As far as I know, Sagem are no longer making the model in question and I know a lot of people who have had problems with them. Does anyone know my legal rights? Can I demand that the shop gives us a refund? I am willing to buy another one from them, just a different model, even if it is more expensive. We live in Ireland by the way.

We are looking for a Contract of Employment for work - it needs to cover things like holiday pay (which may not be included as hours may be too short!), notice when leaving, trial perioods, disciplinary procedings and so on.

All help gratefully received!

The Civil procedure for the litigation a basic Code of Laws relating to the the Courts of Civil Judicature. Social setup and the problems faced by the common man - quite different than today. The law always needed to be amended from time to time to keep it in consonance with ever developing society. A Complicated law of technicalities that due to these complications the parties suffer irreparable loss on account of any mistake of omission and /or commission by not following strictly the provisions of this law. Even a well versed lawyer also can be ensnared by these mistakes. Resultantly the client suffers losses. It requires to be enacted such an easy code that a common educated person can be able to understand the procedure. Mere non-compliance of the present system of procedural law, some time, the controversy between the parties realistically and logically is not possibly being determined and solved by the courts. I had sent my research to rmy Govt. officials but have not got resut

I won a court case for $650 in Luzerne County, PA (in the County courthouse). The defendent did not appeal but has yet to pay me. I went to the Prothonotary, and they told me I need to submit a praecipe to enter judgement against the defendent. What does this need to include? I have no idea how to do this, and they couldn't or wouldn't help me at the Prothonotary's office. I have been unable to find anything online.

A 23 year old downloaded child pornography. He was arrested, served 4 years in prison and 3 years supervised release. He is a registered sex offender for the rest of his life. When he got out of prison, he got a job, but omitted the fact of his crime. They found out and fired him. He now tells the 100% truth whenever he applies for a job. He was applying for at least 5 jobs a day for about 6 months. NO ONE will hire him. Most of these people say it is for a different reason, but we know it isn’t. He applies for the jobs that nobody else wants and is willing to work for the least amount of money. This “monster” (as I am sure some of you will refer to him as) is my brother. He lives in his old beat up car a couple miles out of town because no one will rent to him because of his past. He unfortunately can’t live with us because our landlord won’t let him even visit us on his property. It has been 9 years since he committed the crime.

I say YES. The argument of 'sanctity of marriage' is bull. Hetero couples cheat, divorce, have babies out of wedlock and then there is Vegas! Sanctity my a.s.s. They can't say "it says in the bible" because you can't use religion to your convenience. It also says not to lie, kill, or steal. Either live it yourself to the fullest extent, or shut up. PLUS Seperation of church & state!

Gay couples want to marry for all the same reasons heteros do. Insurance, to raise a family, share a last name, or they love eachother. Why deny that? This should be a citizens vote. Not a bunch of crusty old people who don't even live in our culture.

But thats just MY O P I N I O N. I am not asking anyone to agree.

What's your stand on the subject?

A teenager is rushed to the hospital. They wait all night until she's admitted next day by 6:00 AM. By 7:00 AM a doctor shows up and determines it's appendicitis and she has to undergo surgery (appendectomy). Her parents ask for a CT scan to be completely sure. Doctor says it'll take up to 2-3 hrs before getting the results and the girl needs immediate surgery. He gives instructions to send her to the OR but she waits 7 hrs in her room before she finally enters the OR at 2:30 PM. There is plenty of time to have a CT scan done but it's not done. Appendectomy goes fine but there is nothing wrong with the appendix. The doctor and hospital try to collect money for this and the girl's parents refuse to pay. They look for a lawyer but the case is not attractive money wise, so nobody wants to take it. Doctor’s office threatens to send the account to collections. The parents need help. Is there a way to find a legal representation for them or a doctor's board to report this medical wrong doing

I suggest it was when Bush raised his hand to take the oath of office and swore to "protect the Constititution of the United States of America," which he later illegally altered on his own authority, as if he himself wrote the Constitution or was important for anything but negatives.
