Well, there is already arbitration as an alternative to the current civil litigation system. And small claims courts for smaller matters.

The difficulty is coming up with a set of rules that allow for all the contingencies, while still being streamlined. And that's a balancing act.

The main reason that civil litigation is expensive is because of the adversarial nature of the system. Mediation and collaborative law efforts are much less expensive (often under 10% total cost). But that requires people to be willing to work together to resolve the dispute.
