Right to Evict. A "forcible detainer" action, or eviction, is the landlord's only method for recovering possession when a tenant will not voluntarily relinquish a rented property after termination of the lease. You go down to the clerks office in the county courthouse and file eviction papers through the court. They will set a court date for both you and the tenants to appear in court to state the case. Then the judge will make his/her ruling. This is the only legal way to remove them and their belongings!!!!
The court will help enforce these rulings as well.

If you do not have a long term contract they can have you removed at any time for any reason by the police dept, if you are renting by the day you can be removed by the police for non-payment or infractions of hotel rules, if your term of rental is weekly or monthly then you fall under the New York state land lord tenant act and would be considered a tenant.~

Once you have a court order and an eviction date, you then get the sheriff involved. He'll actually do the eviction. Don't do it yourself, you'll just get in trouble. Let the police physically remove the people from your property.

Oh, wait, legally...ummm....try calling the police. i think that they can legally toss them out. or really, i think you can just hire some bouncers and just throw the squatter out and forcefully move his stuff out, since it is legally your house and he has breached the tenant's agreement.
