In each of the following situations, explain whether the situation involves a tort, a crime or both a tort
and a crime, and discuss the likely outcome of the situation.
(a) Alf, a gas fitter, was installing a new boiler in Bridget’s house. It was nearly lunchtime and Alf
decided to go for lunch leaving a partly-sealed gas pipe which was slowly leaking gas. Alf thought
it would be safe because Bridget had gone shopping. Shortly after Alf had left the house, Bridget
returned, switched on the hall light and was killed in the gas explosion which followed. (4 marks)
(b) Catherine and Della worked in the same office. Catherine knew that Della had been going out with
Finlay, the managing director’s son, and she was jealous because she also fancied Finlay. Catherine
spoke to Finlay and told him that she thought Della had been stealing from the cash box. She then
sent an internal e-mail to Finlay in which she accused Della of theft. Catherine’s allegations about
Della were not true. (4 marks)
(c) Gavin illegally entered Howard’s house at night, took some cash and jewellery and then went to
leave. Howard heard a noise, came running downstairs with a shotgun and fired at Gavin as he was
running across the lawn. Gavin was hit in the back of the leg and injured. (4 marks)

I was pulling into a space, and a guy standing next to the space was waving me in. I didn't think I could make it in because of the car next to me, but the guy kept waving me to pull forward. I rolled down the window and the guy said I had plenty of room. So I pulled forward and nailed the door of the BMW next to me. After I hit the car I backed up and the guy said "Well, I guess you won't make it after all, ha ha ha." and got into an old beat-up pickup truck near the mall. I pulled into a space on the other side and got out to look at the damage. There was a huge crease in the door with a bunch of paint gone from across the door and fender. When the lady came out she asked me what happened. I told her that the guy in the pickup truck hit it. While she was walking over to him I drove away. Isn't the guy in the truck at fault?

Just a quick example. Working stiff, buddy wants to paint and do small plumbing jobs for a slum-lord in town. Just handy-man work. Basic stuff. Slum-lord, won't put him on the payroll because the guy is not licensed, certified, and or carry workmans comp insurance. C,mon, it freaking painting and clean-up work... Well, look around at all the guys, collecting SSI nowadays. Heres your reason: LAWYERS and LEGALITIES! No common sense in law!

Question:

A. Must be in open court because the records were subpoenaed.
B. May be in open court at the discretion of the judge.
C. Must be heard in chambers and sealed from public scrutiny.

This is for my lesson on Confidentiality of Health Information. If anyone could tell me which it should be, and why, I would really really appreciate the help and explanation. Thanks in advance!!!

Information about a law proposed in Maryland (from the Baltimore Sun):

"Under Jewish law, a man must grant his wife a divorce degree, or get, to end a marriage. Without it, a Jewish woman is unable to remarry within the faith...If passed, the measure - up for hearings this week in House and Senate committees in Annapolis - would require those filing for divorce or not contesting one to also file an affidavit stating that they had removed all religious barriers to remarriage within their power."

Is this a violation of the separation between church and state? Is this a good idea?

What do you think of this proposed law in Maryland?

I dont know how anyone can know this, but its worth a try.

People are living longer, and yet pensions are being reduced, standards of care for the elderly in residential homes are poor, and the over 60's are one of the most vulnerable groups in society and also one the most ignored and abused. Maybe we have 30, 40 or 50 years before we reach that age, but shouldn't we start now to make sure that in our latter years, we have a decent standard of life? After all, the powers that be have already secured their future, its the working Man and Woman that's at risk (like always) and to get "them" to do anything that benefits us has always been a long hard struggle. Don't we as the younger generation need to start fighting now to safeguard our future, and also make sure that our children have a good life when they get old?

My grandmother is in a nursing home and has been declared mentally incapacitated. My aunt had control of her money and has lost it and was told she had to become a conservator to regain control. My aunt wants to take her out of the nursing home but the rest of the family wants to keep her in because she has broken her hip twice and needs 24 hour care. With her being incapacitated, does the nursing home have power over her staying there or will my aunt be able to take her out when she becomes conservator. Or will she just have power over her finances? Not sure at all how this works.

An enraged Iranian immigrant used a 3-pound hammer to beat his wife, sister-in-law and mother-in-law to death and then stabbed them repeatedly because he felt "disrespected," police said Monday.

After the attack, Daryoush Ebrahimi, 55, also struck himself several times in the head with the same maul hammer he used to bludgeon his relatives, said Chicago Police Cmdr. Thomas Byrne.

"It was a very difficult scene, and that would be indicative of that type of anger," Byrne said of the two apartments where the bodies were found on the city's far North Side.

Police also found cell phone video messages and a letter that Ebrahimi left at one of the apartments, Byrne said. The FBI is helping translate the messages and letter, which are in Farsi.

"Right now I wouldn't say it's a suicide note ... but it's more about, again, how he feels disrespected, and that's pretty much a reocurring theme in the note," Byrne said.
